AWARDING CONTRACT TO McGUIRE & HESTER ASSOCIATES
FOR PHASE I SANITARY SEWER REHABILITATION AND
RELIEF PROJECT NO. P.W. 4-86-9 AND AUTHORIZING
EXECUTION THEREOF
WHEREAS, the Council of the City of Alameda heretofore
published notice calling for bids for Phase I Sanitary Sewer
Rehabilitation and Relief Project in accordance with
Specifications No. P.W. 4 -86 -9 approved May 5, 1987; and
WHEREAS, in response to said notice sealed bids were
submitted with Valley Engineers, Inc. submitting the lowest bid;
and
WHEREAS, following the bid opening Valley Engineers, Inc.
informed the City that an error existed in their bid and on
August 14, 1987, the City received a letter containing
information documenting the error and a request that the City
allow the withdrawal of their bid; and
WHEREAS, Section 5106 of the State Contract Code states
that if a public entity deems it is for its best interest, it
may, on failure of low bidder to execute the contract, award the
bid to the second lowest bidder; and
WHEREAS, it is in the best interests of the City that
Valley Engineers, Inc. be allowed to withdraw its bid; and
WHEREAS, the second lowest bid was submitted by McGuire &
Hester Associates agreeing to perform said work in accordance
with said Specifications for the sum of $2,436,306.00; and
WHEREAS, said firm is a responsible bidder and its
proposal is the second lowest and best bid received,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that said council hereby consents to release said
Valley Engineers, Inca from its bid for Phase I Sanitary Sewer
Rehabilitation and Relief Project No. P.W. 4 -86 -9.
BE IT FURTHER RESOLVED by the Council of the City
of Alameda that the bid of McGuire & Hester Associates is hereby
accepted, the contract for Phase I Sanitary Sewer Rehabilitation
and Relief Project is hereby awarded to said bidder, subject
to approval of the State Water Resources Control Board, and
the Mayor is hereby authorized to execute, and the City Clerk to
attest, said contract on behalf of the City of Alameda.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 15th of September, 1987,
by the following vote to wit:
AYES: Councilmembers Camicia, Haugner, Monsef, Thomas
and President Corica - 5.
NOES: None.
ABSENT: None.
IN WITNESS WHEREOF, I have hereunto set my hand and
affixed the official seal of said City this 16th day of
September, 1987.
