Resolution 11376CITY OF ALAMEDA RESOLUTION NO. 11376 ESTABLISHING A PERMANENT PUBLIC ACCESS EASEMENT WITHIN THE CITY -OWNED DOOLITTLE LANDFILL SITE WHEREAS, pursuant to California Government Code Sections 66600 through 66661, the City, on March 20, 1987, filed Application No. M87 -8 for a San Francisco Bay Conservation and Development Commission (BCDC) administrative permit, and WHEREAS, said permit was issued to coordinate the activities associated with the Regional Water Quality Control Board mandate to provide closure of the Doolittle Landfill Site and to meet the BCDC requirements involving grading and construction of a public access path and chain link fence within its jurisdiction; and WHEREAS, as a condition of approval of said permit the eight -foot wide public path and its associated access easement reserve, located in Alameda County Assessor Parcel 74- 1040 -1 and the northern portion of Parcel 74- 1040 -2 -2, are required to be dedicated to create permanent rights for public access, and WHEREAS, BCDC has submitted an Agreement Imposing Restrictions on Use of Real Property which contains conditions, covenants and restrictions to comply with the public access requirements; and WHEREAS, it is in the best interests of the City to enter into said Agreement, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that the form of agreement imposing restrictions in perpetuity for public access uses, including walking, sitting, viewing, and related purposes, on the property referred to in the foregoing recitals, and its terms, covenants and conditions be and the same are hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Alameda is hereby authorized and directed to execute on behalf of the City of Alameda that certain Agreement Imposing Restrictions on Use of Real Property between the City of Alameda and the San Francisco Bay Conservation and Development Commission. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 5th of January, 1988, by the following vote to wit: AYES: Councilmembers Camicia, Haugner, Monsef, Thomas and President Corica - 5.
