Resolution 11463CITY OF ALAMEDA RESOLUTION NO. 11463 ORDERING VACATION OF PORTIONS OF A SANITARY SEWER EASEMENT AND AN ELECTRICAL EASEMENT LOCATED WITHIN TRACT 5716 IN THE ALAMEDA MARINA VILLAGE DEVELOPMENT WHEREAS, by its Resolution No. 11434, regularly adopted April 5, 1988, this Council declared its intention to vacate portions of a Sanitary Sewer Easement located within Tract 5716 in the Alameda Marina Village Development, hereinafter more particularly described, all in accordance with provisions of the Public Streets, Highways, and Service Easement Vacation Law (Sections 8320 and following of the Streets and Highways Code of California), and thereafter caused publication and posting of notices of said intended vacation as required by said law, both said publication and notices fixing the time and place for hearing all persons interested in the vacation as Tuesday, May 3, 1988, at 7:30 p.m. in the Council Chamber, City Hall, Alameda, California; and WHEREAS, at said time and place the matter of this proposed vacation came on regularly for hearing by this Council and proof of publication and of posting of said notices in the manner required by law having been made by the City Clerk, and the Council then having heard all the evidence, both oral and documentary, proferred by all persons interested in said matter, and the Council being fully advised in the premises and the matter thereupon submitted for determination. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that: (1) It is hereby found and determined that the Sanitary Sewer Easement and Electrical Easement in said Resolution of Intention and hereinafter particularly described is unnecessary for present or prospective public use, and the public interest requires vacation of same; (2) It is hereby ordered that portions of the Sanitary Sewer Easement within the Alameda Marina Village Development described in Attachment "A" and an Electrical Easement described in Attachment "B" are hereby ordered vacated pursuant to the provisions of Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8333 thereof. N._ a CL , ,--,- 4, Portion of 12.5 Foot Sanitary Sewer Easement to be Vacated Within the Alameda tsarina Village Development All that real property located in the City of Alameda, County of Alameda, State of California, described as follows: COMMENCING at the northwestern corner of Lot 1, as shown on Parcel Map No. 4923, recorded September 1, 1987, in Book 170 of Maps, at Page 72, said point being on the northern line of that 12.5' sanitary sewer easement described in various instruments recorded between August 11, 1952 and December 23, 1958, inclusive, under Recorder's series numbers AG65820, AP52863, and AP135310; Official Records of Alameda County; THENCE easterly along said northern line, 917.19 feet, to a point on the southwestern line of Independence Drive, as shown on Parcel Map No. 4949, recorded June 30, 1987, in Book 170 of Maps, at Page 6, Official Records of Alameda County, California, said point being the TRUE POINT OF BEGINNING; THENCE continuing easterly, along said northern line, 1,205.0 feet to a point on the eastern line of that 10 -foot public utilities easement, as shown on Parcel Map No. 3755, recorded May 21, 1982, in Book 133 of Maps, at page 74; THENCE southerly at right angles, 12.5 feet, to a point on the southern line of said 12.5 foot sanitary sewer easement; THENCE westerly at right angles, 1,195.8 feet, along said southern line, to a point on said southwestern line of Independence Drive; THENCE North 33 °20'05" West, 14.10 feet; THENCE northwesterly along a tangent curve, concave to the southwest, having a radius of 364.00 feet, 0.92 feet through a central angle of 00 °08'42" to the TRUE POINT OF BEGINNING.
