RESOLUTION OF INTENTION TO VACATE PORTIONS OF
A 55 -FOOT PUBLIC UTILITIES EASEMENT LOCATED
WITHIN LOT 1 AND LOT 4, PARCEL MAP NO. 3832 -1;
FIXING TIME, DATE, AND LOCATION FOR A PUBLIC
HEARING; AND ORDERING PUBLICATION AND POSTING
OF NOTICE
BE IT RESOLVED by the Council of the City of Alameda that it
is the intention of this Council, in accordance with the provisions
of Chapter 8, General Vacation Procedure, of the California Streets
and Highways Code, to order the vacation of portions of a 55 -foot
public utilities easement located within Lot 1 and Lot 4, Parcel Map
No 3832 -1, situated in the City of Alameda, County of Alameda,
State of California, and more particularly described as follows:
Being portions of that certain 55 -foot Public Utilities
Easement established on Parcel Map No 3832 -1, recorded
April 5, 1983, in Book 138 of Maps, at Page 1, Official
Records of Alameda County, California, across those
certain parcels of land in the City of Alameda, County of
Alameda, State of California, described as follows:
PARCEL A
COMMENCING at the southwestern corner of Lot 4 as shown
on said Parcel Map No. 3832 -1;
THENCE North 4 °46'53" West, 387.14 feet along the western
line of said lot to the southwestern corner of said
55 -foot Public Utilities Easement, said point being
the TRUE POINT OF BEGINNING;
THENCE North 4 °46'53" West, 55.22 feet along the western
line of said easement to the northwestern corner of
said easement
THENCE South 89 °40'53" East, 918.55 feet along the
northern line of said easement;
THENCE South 12 °56'09" West 56.36 feet to a point on the
southern line of said easement;
THENCE North 89 °40'53" West, 901.33 feet along said
southern line to the TRUE POINT OF BEGINNING.
PARCEL B
COMMENCING at the southwestern corner of aforesaid Lot 4;
THENCE North 4°46'53" West, 442.36 feet along the western
line of said lot to the northwestern corner of
aforesaid 55-foot public utilities easement;
THENCE South 89°40'53" East, 1704.82 feet along the
northern line of said easement to the TRUE POINT OF
BEGINNING;
THENCE continuing along said line, south 89°40'53" East,
121.98 feet to the northeastern corner of said
easement;
THENCE South 00°1907" West, 30.00 feet along the eastern
line of said easement;
THENCE North 89°4053" West, 94.18 feet;
THENCE North 42°3000" West 40.90 feet, to the TRUE POINT
OF BEGINNING.
BE IT FURTHER RESOLVED that reference is hereby made for
particulars of the proposed vacation to that certain map entitled,
"Portions of a 55-Foot Public Utilities Easement Located Within Lot
1 and Lot 4, Parcel Map No 3832-1, To Be Vacated" prepared by
the City of Alameda Engineering Department and on file in the
office of the City Clerk.
BE IT FURTHER RESOLVED that notice is hereby given that the
1st day of November, 1988, at 7:30 p.m. is hereby fixed as the
date and time, and the Council Chambers in the City Hall, Alameda,
California, as the place, for hearing all persons interested in or
objecting to the herein proposed vacation.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to publish a copy of this resolution twice, once in
each of two successive weeks prior to said hearing, in the
official newspaper of the City of Alameda, and to cause to be
posted Notices of said proposed easement vacation in the manner
prescribed in Section 8323 of said Streets and Highway Code.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 4th of October, 1988,
by the following vote to wit:
AYES: Councilmembers Arnerich, Monsef, Thomas and
President Corica 4.
NOES: None.
ABSENT: Councilmember Camicia - 1.
