ORDERING THE VACATION OF PORTIONS OF A 55-FOOT
PUBLIC UTILITIES EASEMENT WITHIN LOT 1 AND LOT
4, PARCEL MAP NO. 3832-1
WHEREAS, by its Resolution No. 11568, regularly adopted
October 4, 1988, this Council declared its intention to vacate
portions of a 55-foot public utilities easement within Lot 1 and
Lot 4, Parcel Map No. 3832-1, hereinafter more particularly
described, all in accordance with provisions of the Public
Streets, Highways, and Service Easement Vacation Law (Sections
8320 and following of the Streets and Highways Code of
California), and thereafter caused publication and posting of
notices of said intended vacation as required by said law, both
said publication and notices fixing the time and place for
hearing all persons interested in the vacation as Tuesday,
November 1, 1988, at 7:30 p.m. in the Council Chamber, City
Hall, Alameda, California; and
WHEREAS, at said time and place the matter of this
proposed vacation came on regularly for hearing by this Council
and proof of publication and of posting of said notices in the
manner required by law having been made by the City Clerk, and
the Council then having heard all the evidence, both oral and
documentary, proferred by all persons interested in said matter,
and the Council being fully advised in the premises and the
matter thereupon submitted for determination.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that:
(1) It is hereby found and determined that the portions
of a 55-Foot Public Utilities Easement in said Resolution of
Intention and hereinafter particularly described are unnecessary
for present or prospective public use, and the public interest
requires vacation of same;
(2) It is hereby ordered that the following portions of a
55-foot Public Utilities Easement in the Alameda Marina Village
Development, situated in the City of Alameda, County of Alameda,
State of California, and more particularly described as follows:
Being portions of that certain 55-foot Public Utilities
Easement established on Parcel Map No. 3832-1, recorded
April 5, 1983, in Book 138 of Maps, at Page 1, Official
Records of Alameda County, California, across those
certain parcels of land in the City of Alameda, County of
Alameda, State of California, described as follows:
PARCEL A
COMMENCING at the southwestern corner of Lot 4 as shown
on said Parcel Map No. 3832 -1;
THENCE North 4 46'53" West, 387.14 feet along the western
line of said lot to the southwestern corner of said
55 -foot Public Utilities Easement, said point being
the TRUE POINT OF BEGINNING;
THENCE North 4 46'53" West, 55.22 feet along the western
line of said easement to the northwestern corner of
said easement;
THENCE South 89 40'53" East, 918.55 feet along the
northern line of said easement;
THENCE South 12 56'09" West 56.36 feet to a point on the
southern line of said easement;
THENCE North 89 40'53" West, 901.33 feet along said
southern line to the TRUE POINT OF BEGINNING.
PARCEL B
COMMENCING at the southwestern corner of aforesaid Lot 4;
THENCE North 4 46'53" West, 442.36 feet along the western
line of said lot to the northwestern corner of
aforesaid 55 -foot public utilities easement;
THENCE South 89 40'53" East, 1704.82 feet along the
northern line of said easement to the TRUE POINT OF
BEGINNING;
THENCE continuing along said line, south 89 40'53" East,
121.98 feet to the northeastern corner of said
easement;
THENCE South 00 19'07" West, 30.00 feet along the eastern
line of said easement;
THENCE North 89 40'53" West, 94.18 feet;
THENCE North 42 30'00" West 40.90 feet, to the TRUE POINT
OF BEGINNING.
BE IT FURTHER RESOLVED that the City Clerk shall cause
certified copies of this order, attested under seal, to be
recorded in the County Recorder's Office and from and after the
date this resolution is recorded the portions of a Public
Utilities Easement vacated no longer shall constitute a public
utilities easement.

I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 1st of November, 1988,
by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Monsef, Thomas
and President Corica - 5.
NOES: None.
ABSENT: None.
