AUTHORIZING EXECUTION OF AGREEMENT FOR
CONSTRUCTION AND COMPLETION OF IMPROVEMENTS
IN CONNECTION WITH SUBDIVISION TRACT 4499,
APPROVING BONDS AS TO-SUFFICIENCY, AND
RELEASE OF BONDS FOR TRACT 4290 (HARBOR BAY
ISLE, VILLAGE 4)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of
the Alameda Municipal Code, Harbor Bay Village Four Associates, a
partnership, subdivider herein, has prepared and presented to
this Council the Final Map of the subdivision known as Tract 4499
which replaces Tract 4290, approved by said Council on December
18, 1979; and
WHEREAS, subdivider has entered into an agreement to
construct and complete the improvements in said subdivision, has
filed the Final Map therefor for approval at this time, and has
posted its bonds guaranteeing full and faithful performance of
said work, all in accordance with said Article; and
WHEREAS, subdivider previously posted three separate
bonds for Tract 4290 which have not been released and consist of
1) a $210,00 bond for Sea View Parkway improvements, 2) a
$13,000 bond for interlocking paving stones; and 3) a $662,000
bond for tract improvements; and
WHEREAS, City shall retain the $210,000 bond for Sea View
Parkway improvements, which are not included under Tract 4499
improvements, and release the $13,000 and $662,000 bonds; and
WHEREAS, it will be to the advantage and benefit of the
City to have said work performed in accordance with said
agreement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the agreement for construction and completion of
the public improvements in said subdivision, and all its terms
and conditions be, and hereby is, approved and the City Manager
and the City Clerk are authorized and directed to execute and
attest to, respectively, said agreement on behalf of the City of
Alameda.
BE IT FURTHER RESOLVED that the bonds in the sum of
$604,000, guaranteeing full and faithful performance of the
subdivider's said public improvements construction contract, are
hereby approved as sufficient in amount.
BE IT FURTHER RESOLVED that the bonds in the sums of
$13,000 and $662,000 for Tract 4290 are hereby released.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 6th of December, 1988,
by the following vote to wit:
AYES: Counci1members Arnerich, Camicia, Thomas and
President Corica - 4.
NOES: None.
ABSENT: Councilmember Monsef - 1.
