ORDERING THE VACATION OF A PORTION OF A FIVE -
FOOT WIDE ELECTRICAL EASEMENT WITHIN LOT 5,
TRACT 3922 (920 OTIS DRIVE)
BE IT RESOLVED by the Council of the City of Alameda that
a portion of that certain electrical easement granted to the City
of Alameda from Alameda Convalescent Hospital, Inc., by that
certain Grant of Easement recorded August 17, 1972, on Reel 3209,
Image 83, Official Records of Alameda County, California, across
that certain parcel of land in the City of Alameda, County of
Alameda State of California, described as follows:
Being a portion of Lot 5 as shown on the Final Map for
Tract 3922, recorded May 5, 1978, under Recorders Series No.
78- 83183, official records of Alameda County, California,
more particularly described as follows:
COMMENCING at the northeastern corner of said Lot 5;
THENCE South 13419'10" West, 10.26 feet to the TRUE POINT OF
BEGINNING;
THENCE South 13 °19 "10" West, 87.74 feet;
THENCE North 76 °40'50" West, 5.00 feet;
THENCE North 13 °19'10" East, 88.87 feet to a point on a
nontangent curve concave to the southwest, having a
radius of 648.00 feet (a radial line to said point
bears North 25 °55'57" East);
THENCE continuing southeasterly along the arc of said curve,
2.84 feet through a central angle of 0 °15'05 ";
THENCE South 63 °48'58" East, 2.28 feet to the TRUE POINT OF
BEGINNING.
Containing 441.527 square feet, more or less.
is hereby ordered vacated pursuant to the provision of Chapter 4,
Part 3, Division 9 of the California Streets and Highways Code,
and particularly Section 8333 thereof.
BE IT FURTHER RESOLVED that reference is hereby made for
particulars of the proposed vacation to that certain map
entitled, "Portion of a 5 -Foot Electrical Easement Located Within
Lot 5, Tract 3922, To Be Vacated" prepared by the City of Alameda
Engineering Department and on file in the office of the City
Clerk.

BE IT FURTHER RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the portion of said
easement ordered vacated herein is unnecessary for present or
prospective public use, and (2) that the portion of said easement
has never been used by the City of Alameda for any purpose
whatever since the date of its acquisition to the date of this
resolution.
BE IT FURTHER RESOLVED that the City Clerk shall cause
certified copies of this order, attested under seal, to be
recorded in the County Recorder's Office and from and after the
date this resolution is recorded the portion of an electrical
easement vacated no longer shall constitute an electrical
easement.
