AUTHORIZING EXECUTION OF AN AGREEMENT WITH
THE PORT OF OAKLAND FOR THE CONSTRUCTION AND
MAINTENANCE OF A STORM DRAIN SYSTEM INTO A
TIDALLY-INFLUENCED LAGOON WITHIN PORT OF
OAKLAND PROPERTY
WHEREAS, the Settlement Agreement between Harbor Bay Isle
and the City of Alameda required them to continue to negotiate
with the Port of Oakland to provide an acceptable Agreement
concerning storm water drainage into the airport lagoon; and
WHEREAS, said Agreement between the Port of Oakland and
the City of Alameda provides for the installation of two City
storm drains which serve public streets and the Business Park
Development of Harbor Bay Isle and will drain into the Port
Lagoon; and
WHEREAS, said drains have been installed except for the
last 100 feet which await the execution of this Agreement and the
required permits from BCDC and the Corp of Engineers; and
WHEREAS, said Agreement provides for the permanent
connection of the storm drains into the Port Lagoon and the
maintenance of the lagoon area by the City including both routine
recurring maintenance and special maintenance at the outfall;
and
WHEREAS, said Agreement has been in negotiation between
the City of Alameda and the Port of Oakland for a couple of years
and the various details have been resolved to the satisfaction of
all parties;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the City Manager and the City Clerk be, and each
hereby is, authorized and directed to execute and to attest to,
respectively, on behalf of the City, an agreement with the Port
of Oakland for the construction and maintenance of a storm drain
system into a tidally-influence lagoon within Port of Oakland
property.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 16th of May, 1989,
by the following vote to wit:
AYES: Councilmembera Arnerich, Camicia, Thomas,
Withrow and President Corica 5.
