APPROVING PARCEL MAP 5767 (INDEPENDENCE PLAZA -
ALAMEDA SENIOR HOUSING PROJECT) AND PERMITTING
RECORDING THEREOF
WHEREAS, the Housing Authority of the City of Alameda, a
public body corporate and politic of the Estate of California,
owner and subdivider herein, has presented to the Council for
approval Parcel Map 5767 to subdivide a 5.01 acre lot into two
lots containing 4.73 and 0.28 acres located north of Atlantic
Avenue, bounded by Webster Street and Constitution Way, and being
a portion of Tract 32 as shown on that map entitled "Map of
Alameda Marsh Lands" as filed in Book 25 of Maps, at Pages 74 to
78, Alameda County Records, Alameda, California; and
WHEREAS, said Parcel Map delineates thereon an easement
for public utilities over, under, in and upon the areas
designated "Public Utilities Easement" (PUE), dedicated to the
City of Alameda;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that pursuant to Section 11-319.1 of the Alameda
Municipal Code, Parcel Map No. 5767, heretofore accepted and
conditionally approved by the Planning Board, is hereby approved
and permission given to subdivider to record same, based upon the
findings and subject to the conditions set forth in City of
Alameda Planning Board Resolution No. 1975 passed on September
11, 1989.
BE IT FURTHER RESOLVED that the easement for public
utilities dedicated to the City of Alameda is hereby accepted, on
behalf of the City, for use in conformity with the terms of the
offers of dedication.
BE IT FURTHER RESOLVED that pursuant to Section
11-3112(f) of the Alameda Municipal Code the City Council finds
Parcel Map No. 5767 is consistent with the City's General Plan.
BE IT FURTHER RESOLVED that this Resolution will not
become effective until after the expiration of the appeal period
from the Planning Board's decision, which is September 22, 1989,
and will not become effective if there are appeals received on
the Planning Board's decision.
