Resolution 11846CITY OF ALAMEDA RESOLUTION NO. 11846 AMENDMENT TO RESOLUTION NO. 8841 PERTAINING TO AUTHORITY OF SELF - INSURANCE CLAIMS BOARD WHEREAS, on December 20, 1977, Resolution No. 8841 was adopted which established the Claims Board in connection with City's Liability Self - Insurance program and delegated authority to write checks and pay claims of $5,000 or less; and WHEREAS, lawsuits based upon the claim are frequently filed after the claim is rejected; and WHEREAS, for the past twelve years, the administrative interpretation of Resolution No. 8841 is that the Claims Board has the authority to settle a lawsuit in the amount of $5,000 or less; and WHEREAS, good fiscal management practices of day -to -day operation of a self - insurance plan require delegation to pay workers' compensation claims of $5,000 or less to the Claims Board; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that Resolution No. 8841 is hereby amended to provide that the Secretary of the Claims Board shall have the authority to issue checks from the Claims Account for payment against the City as follows: 1. Subject to the limit of $15,000, the Secretary is authorized to issue checks upon approval of the Claims Board to settle, compromise and dismiss claims and lawsuits against the City; 2. Subject to the limit of $15,000 per workers' compensation claim, the Secretary is authorized to issue checks upon approval of the Claims Board.
