AUTHORIZING PURCHASE OF EQUIPMENT IN THE OPEN MARKET
PURSUANT TO SECTION 3-15 OF THE CITY CHARTER
WHEREAS, at the July 5, 1989, meeting of the Council of the
City of Alameda the budget for fiscal year 1989-90 which included
the purchase of various pieces of equipment for the Public Works
Department was adopted; and
WHEREAS, the City can realize from $1,000 to $1,500
savings/unit by purchasing certain equipment in the open market;
and
WHEREAS, in accordance with Section 3-15 of the City Charter,
when materials or supplies can be purchased at a lower price in the
open market, the Council may effect such purchase(s); and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that pursuant to Section 3-15 of the City Charter, the City
Purchasing Agent is hereby authorized to purchase two one-half ton
pick-up trucks, one personnel lift bucket truck and one medium size
car in the open market.

AUTHORIZING OPEN MARKET PURCHASE OF
UNDERCOVER SYSTEM FOR THE POLICE DEPARTMENT
WHEREAS, there are funds available in the Equipment
Replacement Fund to allow for the purchase of a undercover system
for the Police Department; and
WHEREAS, it has been determined that the best system
available is Unitel 210 Intelligence System; and
WHEREAS, Audio Intelligence Devices of Fort Lauderdale,
Florida offers to provide one undercover system at the all
inclusive net price of $13,053.05; and
WHEREAS, in accordance with Section 3 -15 of the City
Charter, the Council may determine that materials or supplies can
be purchased at a lower price in the open market and thereupon
proceed to purchase such materials in the open market.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that pursuant to Section 3 -15 of the City Charter the
City Purchasing Agent is hereby authorized to purchase one
undercover system from Audio Intelligence Devices at the. all
inclusive cost of $13,053.05 in the open market without formal
bidding procedures.

CITY OF ALAMEDA RESOLUTION NO. 11852
AUTHORIZING STAFF TO NEGOTIATE IN THE OPEN MARKET FOR
PLANTING OF THE PORTOLA TRIANGLE DEMONSTRATION GARDEN
WHEREAS, at its meeting of September 5, 1989, the Council of
the City of Alameda approved an appropriation of $108,600 from the
Dwelling Unit Tax account to fund the construction phase of
developing the Portola Demonstration Garden; and
WHEREAS, said construction phase which consists of grading the
site, installation of a drainage system, irrigation lines and
construction of pathways is underway and ready to begin the
planting phase; and
WHEREAS, costs for the 2.3 acre site are estimated at $12,500
and can best be handled by negotiating in the open market due to
the following:
1. Planting of the meadow grass and wild flowers have to be
done by mid November for proper germination. This
restrictive schedule does not allow time for a formal bid
process;
2. The plants have to be purchased from nurseries throughout
California, will be arriving at various times of the
planting season and must be stored by the contractor
until the planting segment begins. This will take a
great deal of coordination and it is essential that staff
work with a local contractor; and
3. The coordination aspects, responsibilities, provisions
and conditions of said project are very difficult to
define in the scope of formal bid specifications;
WHEREAS, in accordance with Section 3-15 of the City Charter,
when great necessity or emergency requires immediate action, the
Council may thereupon proceed to make such public work or
improvements without contract in the open market;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that pursuant to Section 3-15 of the City Charter, the
Recreation and Park Department Staff is hereby authorized to
negotiate in the open market, without formal bidding procedures,
for planting of the Portola Triangle Demonstration Garden.

AUTHORIZING EXECUTION OF AGREEMENT WITH PETER CULLEY AND
ASSOCIATES FOR ASSISTING IN THE PREPARATION OF A MITIGATION
AND IMPLEMENTATION PROGRAM FOR POTENTIALLY
HAZARDOUS BUILDINGS (URM'S - SB 547/1986)
WHEREAS, on January 27, 1989, this Council approved a
status report on Senate Bill 547 - Unreinforced Masonry Buildings;
and
WHEREAS, on August 11, 1989, a Request for Proposals was
sent out to thirteen engineering firms; and
WHEREAS, on August 25, 1989, five proposals in response
were received.
WHEREAS, after evaluation of the proposals by the U.R.M.
Committee, the firm of Peter Culley and Associates was selected,
on the basis of its experience for assisting in the preparation of
a Mitigation and Implementation Program for Potentially Hazardous
Buildings (URM's - SB 547/1896).
NOT, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the City Manager and the City Clerk be, and each
hereby is, authorized and directed to execute and to attest to,
respectively, on behalf of the City, an agreement with Peter Culley
and Associates, for assisting in the preparation of a Mitigation
and Implementation Program for Potentially Hazardous Buildings
(URM's SB 547/1986).

WHEREAS, the City Council of the City of Alameda has
appropriated funds in the 1989 -90 Budget for the development of a
City Cost Allocation Plan /User Fees Study; and
WHEREAS, the firm of David M. Griffith and Associates,
LTD has submitted a proposal to conduct said study;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the City Manager be and hereby is authorized
to execute, and the City Clerk to attest to, on behalf of the
City, the agreement between the City of Alameda and David M.
Griffith & Associates, LTD to conduct a fee and charge cost
analysis for the City of Alameda.
