CITY OF ALAMEDA RESOLUTION NO. 12201
AUTHORIZING OPEN MARKET PURCHASE OF BACKHOE LOADER
FOR CHUCK CORICA GOLF COMPLEX,
WHEREAS, there is the necessity to purchase a backhoe loader
for maintenance projects at the Chuck Corica Golf Complex; and
WHEREAS, funds were appropriated in the Golf Enterprise Fund
1990 -91 fiscal year Capital Outlay budget for the purchase of a
backhoe loader; and
WHEREAS, a suitable piece of equipment could not be located
during the 1990 -91 fiscal, therefore, appropriations lapsed on June
30, 1991; and
WHEREAS, the Golf Manager has conducted research into the
purchase of a backhoe loader and has located a used 1991 John Deere
310D backhoe loader for the purchase price of $39,639, including
tax and delivery; and
WHEREAS, the cost of a new backhoe loader is approximately
$65,000; and
WHEREAS, the Golf Manager has requested that $39,639 be
reappropriated from the Golf Enterprise Fund to purchase the used
310D backhoe loader manufactured by John Deere Company of Iowa;
WHEREAS, Section 3 -15 of the City Charter provides that the
0 U City Council, by four affirmative votes, can authorize an open
market purchase if it determines that the materials or supplies can
be purchased at a lower price in the open market.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Alameda has determined that the equipment can be purchased
at a lower price in the open market;
BE IT FURTHER RESOLVED by the Council of the City of Alameda,
by 4/5 vote, the City Purchasing Agent is hereby authorized to
purchase one used 1991 John Deere 310D backhoe loader, at the all
inclusive cost of $39,639 in the open market without formal bidding
procedures.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
city of Alameda in regular meeting assembled on the eighteenth
day of February, 1992, by the following vote to Witt
AYES! Councilmembers Arnerich, Camicia, LUcae, Roth and
President Withrow - 5.
NOES: None.
ABSENT! None.
ABSTENTIONS! None.
