Resolution 12222CITY OF ALAMEDA RESOLUTION NO. 12222 ENDORSING A REVISED VOTING STRUCTURE FOR CONGESTION MANAGEMENT AGENCY WHEREAS, the Alameda County Congestion Management Agency (CMA) was created pursuant to California Government Code, Section 65089; and WHEREAS, a Joint Powers Agreement (JPA), dated February 20, 1991, defining the roles, purpose, objectives, responsibilities, powers and duties of the CMA, was approved and executed by the Alameda County Board of Supervisors and a majority of the cities representing a majority of the population in the incorporated area of Alameda County; and WHEREAS, Section 10.a. of the JPA, Board Organization, was amended by a vote of the majority of the cities representing a majority of the population in the incorporated area, and by the 0 Board of Supervisors acting last on February 11, 1992 to read as follows: 2- An (J) An initial vote for the Alameda County Board of Supervisors and each Alameda County city for initial 50,000 population or fraction thereof; Additional votes shall accrue to the County and cities as each jurisdictions's population reaches the midpoint of the next highest increment of 50,000 (e.g., 25,001 or more); One voting representative each for AC Transit and BART, and; WHEREAS, in adopting the above change to the voting structure of the CMA, the Board of Supervisors indicated a willingness to consider any other plan brought forward by the cities and that they would like to see such a plan include changes in voting rights for transit operators; and WHEREAS, the Mayors' Conference considered this matter at its March meeting; and WHEREAS, Mayor William Withrow, City of Alameda, circulated a proposal, dated March 12, 1992, based on the discussion at the Mayors' Conference meeting, that would provide voting rights to cities and the County and would give advisory status to transit operators, Metropolitan Transportation Commission, the Bay Area Air Quality Management District, and Caltrans; NOW, THEREFORE, BE IT RESOLVED, that the City of Alameda approves an amendment to Section 10.a. "Board Organization" of the Alameda County Congestion Management Agency Joint Powers Agreement dated February 20, 1991, as amended, providing that the voting composition of the CMA Board shall be as follows: An initial vote for the Alameda County Board of Supervisors and each Alameda County city for initial 100,000 population or fraction thereof. Additional votes shall accrue to the County and cities as each jurisdiction's population reaches the midpoint of the next highest increment of 100,000 (e.g., 50,001 or more). The Transit Operators, Metropolitan Transportation Com- mission, the Bay Area Air Quality Management District, and Caltrans shall be advisory members with the right to participate in all discussions, to make motions and to serve as voting members of CMA committees. Advisory members shall not vote on motions or actions of the CMA Board and shall not count in determining a quorum. and; BE IT FURTHER RESOLVED, that E. William Withrow, Jr., Mayor, is authorized to execute an amendment on behalf of the City of Alameda to the JPA, which incorporates the voting changes described herein. BE IT FURTHER RESOLVED, that this Resolution shall only become effective when a majority of the cities representing a majority of the population have so approved. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 7th day of April , 1992, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Lucas, Roth and President Withrow - 5.
