Resolution 12228CITY OF ALAMEDA RESOLUTION NO. 12228 OBJECTING TO THE HOUSING NEEDS DETERMINATION BY THE ASSOCIATION OF BAY AREA GOVERNMENTS (ABAG) AND REQUESTING ABAG AND THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT (HCD) TO REVIEW AND MODIFY THE METHODOLOGY USED TO DETERMINE REGIONAL HOUSING ALLOCATIONS WHEREAS, the City of Alameda has shown social responsibility by providing permanent lower income housing units and homeless shelters; and WHEREAS, the City of Alameda has a certified Housing Element which includes the ABAG 1988 Housing Needs Determination figures (HND); and WHEREAS, California Government Code section 65584(a) requires "...The distribution (of regional housing needs) shall seek to reduce the concentration of lower income households in cities or counties which already have disproportionately high proportions of lower income households.11 and WHEREAS, the City of Alameda provides 3,155 permanent, assisted residential units out of a total housing stock of 30,833 permanent units, thereby providing more than 10% of its housing stock to lower income households; and WHEREAS, the past and projected average household income for the City of Alameda is below the average household income for the County of Alameda and considerably below the average household income for the Bay Area; and WHEREAS, the current methodology used by ABAG for determining regional housing needs disregards the mandate of section 65584(a) of the California Government Code against impaction; and WHEREAS, ABAG and HCD will generate new HND figures beginning in 1993 which will be released in 1994; and WHEREAS, the specific methodology for making the HND is not set forth in the Government Code but is determined by each Council of Governments and HCD; NOW, THEREFORE, BE IT RESOLVED by the City Council that the City of Alameda objects to the methodology which has been used by ABAG in assigning HND quotas to the City of Alameda. BE IT FURTHER RESOLVED that the City Council requests ABAG and HCD to review the methodology used to arrive at the HND in view of the mandate against further impaction under section 65584(a) of the Government Code. In particular, ABAG and HCD should exempt all cities and counties which provide more than 5% of their dwelling units for lower income households from further quotas for lower income housing. BE IT FURTHER RESOLVED that City staff shall carefully review the process used to determine future housing needs quotas, and, if necessary, shall pursue all appropriate avenues to revise future HND's. BE IT FURTHER RESOLVED that the City Clerk shall transmit a copy of the resolution to ABAG, HCD, League of California Cities and the Governor's Office.
