Resolution 12318CITY OF ALAMEDA RESOLUTION NO. 12318 AUTHORIZING EXECUTION OF GRANT OF EASEMENT TO THE STATE OF CALIFORNIA TO MAINTAIN A BICYCLE BRIDGE ACROSS THE SAN LEANDRO CHANNEL, SAID BRIDGE BEING KNOWN AS THE BAY FARM ISLAND BICYCLE BRIDGE WHEREAS, the State of California, through its Department of Transportation, ( "the State ") will be engaged in the maintenance of a bicycle bridge connecting the City of Alameda proper with Bay Farm Island; and WHEREAS, the State requires a right of way easement for the maintenance of such bridge over and across certain tidelands in San Leandro Channel; and WHEREAS, said tidelands are under the jurisdiction and control of the City of Alameda under the terms of a grant made by the State of California to the City in 1913; and WHEREAS, public interest and necessity require that such easement be granted in accordance with the terms and conditions of that certain form of grant of easement heretofore prepared and submitted to this Council; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Mayor of said City, be, and he is hereby authorized and directed to execute, and the City Clerk to attest, on behalf of the City, a grant of easement, substantially in the form and containing the terms and conditions set forth in the aforesaid grant of easement attached hereto as Exhibit A. EXHIBIT "A" CORPORATION EASEMENT DEED SPACE ABOVE THIS LINE FOR RECORDER'S USE DISTRICT COUNTY ROUTE POST MILE NUMBER 4 ALA 61 18.7 52259 City of Alameda, a municipal corporation, does hereby GRANT to the State of California an EASEMENT for the bike bridge connectinE the bike route between the main island and Bay Farm Island. and incidents thereto upon, over and across that certain real property in the City of Alameda County of Alameda , State of California, described as follows: Being a portion of Tidelands Lot 41/2, in Section 19, Township 2 South, Range 3 West, Mount Diablo Base and Meridian, as said lot, section, township, and range are delineated and so designated on that certain map entitled, "Map No. 2 of Salt Marsh and Tide Lands situate in the County of Alameda, State of California, 1871," and delineated in the field notes thereof, -and certified copies thereof having been filed with the County Recorder of the City and County of San Francisco, and in the office of the Department of Finance, Division of State Lands, State of California, and being more particularly described as follows: BEGINNING at the easterly terminus of that course described as S 88 °56'10" E, 282.28 feet in "Parcel No. 22" of that Final Order of Condemnation recorded April 24, 1951 in Book, 6418, Page 388 of Official Records of Alameda County, said point being also the beginning of a curve concave to the east having a radius of 370.00 feet, said curve also being a portion of the northeastern line of State right -of -way, said curve having a radial bearing at said point into the center of curve South 88 °02'45" East; Emu Rri 02 -1e tREV. 12-82 90 58752 4-AIA-61-18.7-(52259) THENCE southerly along the arc of said curve through a central angle of 7°00'56", an arc distance of 45.30 feet; THENCE South 86°21'02" East, 77.86 feet; THENCE North 79°36'31" East, 40.00 feet; THENCE North 10°23'29" West, 498.14 feet to a point on the eastern line of the parcel of land described in the easement deed to the State of California recorded July 1, 1954, in Book 7360, Page 301, Official Records of Alameda County; THENCE South 3°38'58" West, 447.85 feet along said right-of-way line to the POINT OF BEGINNING. Containing 30,111 square feet, more or less. The bearings and distances used in the above description are on the California Coordinate System of 1927, Zone 3. Multiply the above distances by 1.0000708 to obtain ground level distances.
