ESTABLISHING A PENALTY STRUCTURE FOR
TRANSPORTATION SYSTEMS MANAGEMENT
WHEREAS, the Alameda Municipal Code and the California
Government Code provide that the City Council may set fees for
reasonable cost of providing various services by resolution; and
WHEREAS, the City Council, at the August 27, 1991 Special
City Council meeting, directed City staff to amend the Alameda
Municipal Code to reflect that City fees shall be set by City
Council Resolution; and
WHEREAS, the City Council, at the September 1, 1992 City
Council meeting, authorized and adopted, by Ordinance, the
amendment of Chapter VIII (Transportation Systems Management) to
Conform with Congestion Management (CMP) Requirements, including
establishing a Penalty Structure for Transportation Systems
Management; and
WHEREAS, the City Council has determined that the Penalty
Structure for Transportation Systems Management established by this
Resolution are reasonable;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that City Council, by Resolution, establish a Penalty
Structure for Transportation Systems Management Program as detailed
in Exhibit A attached hereto.
BE IT FURTHER RESOLVED that this Resolution shall not
become effective until the effective date of the adoption of the •
required implementing ordinance.

I, the undersigned, hereby certify that the foregoing Resolution

City of Alameda in regular meeting assembled on the 15th day of
