Resolution 12350CITY OF ALAMEDA RESOLUTION NO. 12350 DECLARING CANVASS OF RETURNS AND RESULTS OF CONSOLIDATED GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, NOVEMBER 3, 1992. WHEREAS, a Consolidated General Municipal Election, under and pursuant to the provisions of Article XIX of the Charter of said City, for the purpose of electing officers to the office of Councilmember, Auditor, Treasurer, and Member of the Board of Education, and for the further purpose of submitting to the qualified electors amendments to the Charter of the City of Alameda, and an Advisory Measure as set forth hereinafter: Two (2) Councilmembers on the Council of said City for two full terms, each term commencing at 8:00 o'clock p.m. on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; One (1) Auditor of said City for one full term commencing at 8:00 o'clock p.m. on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; ILI One (1) Treasurer of said City for one full term commencing at 8:00 DC o'clock p.m. on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected a: tE qualified; Three (3) members of the Board of Education of said City, each term commencing at 7:30 o'clock p.m. on the fourth Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified. MEASURE D Shall the Alameda City Charter be amended to repeal provisions of the Charter which prevent additional financial burdens from being imposed on taxpayers as a result of binding arbitration without a vote of the people and to enlarge the scope of such binding arbitration for fire employees to include, in addition to financial benefits, all matters related to wages, hours and work conditions as more fully set forth in Alameda City Council Resolution No. 12299? MEASURE E Shall the City Charter of the City of Alameda be amended to prohibit tax increases without voter approval due to binding arbitration related to fire fighters regular monthly salary range and to prevent fire fighter strikes by adopting such binding arbitration provisions? The amendment will be accomplised by repealing existing Article XXVII adopting new Article XXVII and by amending Charter Section 17-17 more fully set forth in Alameda City Council Resolution No. 12302. MEASURE F Shall the City Council authorize negotiations with the City's Firefighters' Union in order to implement an alternative work schedule to change the existing work schedule of approximately ten shifts per month to twenty shifts of shorter duration per month? WHEREAS, nominating petitions were duly and regularly presented to, and filed in the Office of the City Clerk of the City of Alameda, in the time, form and manner prescribed by law, nominating for said offices: ALAMEDA CITY COUNCIL Anthony J. VanHook WHEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the time, form and manner prescribed by law, whereupon a Notice of Nominees for public office containing a statement of the time of the election, the offices to be filled, and the names of the candidates to be voted on, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said City, the last publication there of being more than five (5) days before the date of said election; and WHEREAS, a Notice of the Proposed Amendments to the Charter of the City of Alameda and Advisory Measure, certified by the City Clerk, was duly issued and published in the official newspaper of said City in the manner and time prescribed by law; and WHEREAS, there were 57 election precincts within the City of Alameda fixed and designated; and WHEREAS, all of the ballots used for said election were prepared, as to form and content, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten (10) days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and WHEREAS, the Council of the City of Alameda, twenty-eight days following said election, has met and fully canvassed the returns of the votes cast at said Consolidated General Municipal Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as follows: (1) That said Consolidated General Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (2) That the whole number of ballots cast in the City of Alameda at said election was 31,183. (3) That the total number of votes cast in the City of Alameda at said election for each of the aforementioned candidates for the office of City Council of said City was as follows: Anthony J. Kearney 18,630 (6) That the total number of votes cast in the City of Alameda at said election for the aforementioned candidate for the office of Treasurer of said City was as follows: Lewis E. Hurwitz 17,892 (7) That the total number of votes cast in the City of Alameda at said election for the aforementioned candidates for the office of Board of Education Member of said City was as follows: Gail Ann Greely Barbara Rasmussen Bill Garvine Val Jue A. VanHook 13,274 13,201 12,125 10,040 6,337 5,126 3,809 (8) That the total number of votes cast in the City of Alameda at said election for the aforesaid Charter Amendment Measures was as follows: Measure D Yes 12,169 No 14,318 Measure E Yes 12,529 No 13,933 (9) That the total number of votes cast in the City of Alameda at said election for the aforesaid Advisory Measure was as follows: Measure F Yes 14,566 No 9,791 NOW, THEREFORE, BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that the aforesaid Anthony J. "Lil" Arnerich and Ralph J. Appezzato having received the two highest number of votes cast for the office of Councilmember, were, and are hereby declared to be, duly and regularly elected to the office of Councilmember of the City of Alameda, each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Kevin R. Kearney having received 18,630 votes cast for the office of City Auditor, was, and is hereby declared to be, duly and regularly elected to the office of Auditor of the City of Alameda, for a term beginning at 8:00 o'clock p.m., on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Lewis E. Hurwitz having received 17,892 votes cast for the office of Citl Treasurer, was, and is hereby declared to be, duly and regularly elected to the office of Treasurer of the City of Alameda, for a term beginning at 8:00 o'clock p.m., on the third Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Gail Ann Greely, Barbara Rasmussen and Bill Garvine having received the three highest number of votes cast for the office of Member, Board of Education, were, and are hereby declared to be, duly and regularly elected to the office of Member, Board of Education of the City of Alameda, each for a term beginning at 7:30 p.m. o'clock on the fourth Tuesday in December, 1992, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Measures D and E, each having received a majority of the number of "No" votes cast, were, and they are declared, not passed. BI IT FURTHER RESOLVED AND DECLARED that the aforesaid Measure F having received a majority of the number of "Yes" votes cast, was, and it is hereby declared, passed.
