Resolution 12376CITY OF ALAMEDA RESOLUTION NO. 12376 RESOLUTION OF INTENT INITIATING PROCEEDINGS FOR FORMATION OF THE BAY FARM ISLAND DIKE MAINTENANCE ASSESSMENT DISTRICT OF THE CITY OF ALAMEDA RESOLVED, by the City Council (the "Council") of the City of Alameda (the "City"), California that: 1. Authority. The Council hereby proposes the formation of a maintenance assessment district under the City of Alameda Maintenance Service Law, being Article V of Chapter III, of the Alameda Municipal Code (the "Code") which incorporates by reference provisions of the Landscape and Lighting Act of 1972, being Part 2 of Division 15 of the California Streets and Highways Code (the "Act"). 2. District Described. The proposed maintenance assessment district is hereby designated the "City of Alameda Bay Farm Island Dike Maintenance Assessment District No. 93-1," (the "District"), the extent of territory of which is indicated by a boundary line on a map thereof on file and open to public inspection in the Office of the City Clerk of the City and to which map further reference is hereby made. 3. Improvements to be Maintained. The improvements to be maintained by the assessments levied within the District consist of repairs to the Bay Farm Island dike in the event of a major dike failure. 4. Engineer Designated; Report. Bissell & Karn of San Leandro, California, are hereby designated as engineers (the "Engineers") for the District and are hereby authorized and directed to prepare a report in accordance with Section 22565 of the Act, and upon the completion thereof, to file the same with the City Clerk. The City Manager is hereby authorized and directed to enter into a contract or agreement with the Engineer for the services required for the District. 5. Special Counsel. The law firm of Jones, Hall, Hill & White, a Professional Law Corporation, San Francisco, California, is hereby designated as special counsel (Special Counsel) to perform all legal services required in the formation of the District, including the preparation of all required documents, resolutions, notices and the rendition of advice to members of the City staff, the Engineer and others in the conduct of all proceedings through and including the formation of the District and the levy of the first assessment. The City Attorney is hereby authorized and directed to enter into a contract or agreement with Special Counsel for the service thereof. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 6th day of April , 1993, by the following vote to wit: AYES: Councilmembers Arnerich, Lucas and Roth - 3.
