Resolution 12391CITY OF ALAMEDA RESOLUTION NO. 12391 ESTABLISHING GARBAGE FEES FOR DEPARTMENT OF DEFENSE PROPERTY WHEREAS, Ordinance No. 2629 of the City Council was adopted on May 4, 1993, which provides that for services of collection of disposal of garbage and refuse on Department of Defense property the Department of Defense shall select a scavenger in compliance with federal rules and regulations and set the rates to be charged by a scavenger; and WHEREAS, Ordinance No. 2629 provides that the scavenger for the Department of Defense shall pay to the City of Alameda a garbage fee as set by City Council resolution. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that the following is the garbage fee to be paid to the City of Alameda by the scavenger for Department of Defense property: Ten percent (10%) of the gross revenue derived by the scavenger for the Department of Defense for collection and disposal of garbage and refuse on Department of Defense property. BE IT FURTHER RESOLVED that starting on May 1, 1993, garbage fees shall be computed and paid on the basis of billings issued each calendar month, plus receipts for services transacted on a cash basis, plus cash received on account of services rendered between May 1, 1993 and June 30, 1993. The scavenger shall prepare and mail remittances each month not later than twenty calendar days after the end of each month. The remittance shall be accompanied by reports setting forth the basis and calculations used for computing the amount due. The figures used shall be reconciled to the general books of account of the scavenger. BE IT FURTHER RESOLVED that starting on July 1, following the date of this Resolution, garbage fees shall be computed and paid on the basis of billings issued each calendar month, plus receipts for services transacted on a cash basis, plus cash received on account of services rendered during this fiscal year defined as the twelve calendar months between July 1st and June 30th. The scavenger shall prepare and mail remittances each month not later than twenty calendar days after the end of each month. The remittance will be accompanied by reports setting forth the basis and calculations used for computing the amount due. The figures used shall be agreed to the general books of account of the scavenger. BE IT FURTHER RESOLVED that this Resolution shall not become effective until the effective date of the adoption of required implementing ordinance. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 4th day of May , 1993, by the following vote to wit: AYES: Councilmembers Appezzato, Arnerich, Lucas, Roth and President Withrow - 5.
