PROVIDING CERTIFICATIONS REQUIRED FOR
ALLOCATION OF PROPOSITION 116 FUNDS
TO BAY FARM ISLAND BIKE BRIDGE PROJECT
WHEREAS, the California Transportation Commission (CTC) has
approved $1 million in Proposition 116 bond funds for the City of
Alameda's Bay Farm Island Bike Bridge project; and
WHEREAS, CTC requires that the City provide various certi-
fications in the form of a formal resolution prior to allocating
these funds;
NOW, THERE-ORE, BE IT RESOLVED that the City of Alameda will
not adopt new or increased development taxes, fees, exactions, or
permit fees for the purpose of providing local matching funds, if
such matching funds are required, for the project, or the project's
operation; and
BE IT FURTHER RESOLVED that the City of Alameda, when
acquiring property or constructing capital improvements on the
project, will exercise due diligence in the discovery of hazardous
wastes, and that the City of Alameda will enter into enforceable
agreement(s) witn any and all owners of to-be-acquired properties
for clean-up of hazardous waste on or below the acquired property;
and
BE IT FURTHER RESOLVED that the City of Alameda hereby
certifies that no other capital funds previously programmed,
planned, or approved for bicycle projects will be used for other
purposes; and
BE IT FURTHER RESOLVED that the City of Alameda certifies that
no other State funding sources will be used to complete this
project if project costs exceed those identified in the approved
application; and
BE IT FURTHER RESOLVED that the City of Alameda certifies that
it has the financial and institutional ability to accept the legal
liabilities associated with this project.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 6th day of
July , 1993, by the following vote to wit:
Councilmembers Appezzato, Arnerich, Lucas, Roth
and President Withrow - 5.
