ADOPTING NEGATIVE DECLARATION IS -93 -5,
FOR THE CITY'S ACQUISITION OF 10.28 ACRES OF LAND
AND THE DEVELOPMENT OF ADULT SOCCER FIELD(S)
ON PARCEL 5 AND A PORTION OF PARCEL 4 OF PARCEL MAP 5274,
IN MAP BOOK 176 PAGES 4 -11 LOCATED AT THE INTERSECTION
OF HARBOR BAY PARKWAY AND SOUTH LOOP ROAD
WITH THE HARBOR BAY BUSINESS PARK
WHEREAS, an application was made on October 25, 1993 by the
City of Alameda, for an Initial Study, IS -93 -5, to determine the
potential environmental effects that would be associated with the
City's acquisition of 10.28 acres of land and development of an
adult soccer field(s) located on parcels 5 and a portion of parcel
4 of Parcel Map 5274 (as consolidated into a reconfigured Lot 5 by
a Lot Line Adjustment recorded October 12, 1990) located at the
intersection of Harbor Bay Parkway and South Loop Road; and
WHEREAS, business park development has previously been
approved for the site as part of the Harbor Bay Business Park and
has been previously evaluated in the certified Environmental Impact
Report for Harbor Bay Isle; and
WHEREAS, the proposed building which may be constructed for
the University of California at San Francisco on this site in
addition to the soccer field(s) is consistent in terms of use and
scale with the business park as previously approved; and
WHEREAS, a proposed Negative Declaration w:s prepared and
circulated for public comment between November 5, 1993 and November
29, 1993; and
WHEREAS, no written comments were received; and
WHEREAS, no potential for significant adverse impacts was
identified in Initial Study 93 -5; and
WHEREAS, the subject property is designated Business Park on
the General Plan Diagram; and
WHEREAS, the subject property is located in a C -M -PD
(Commercial Manufacturing Planned Development) District; and
WHEREAS, the Planning Board at their meeting of November 29,
1993, recommended to the City Council that a Negative Declaration
be adopted; and
WHEREAS, the City Council has held a public hearing on this
application on November 30, 1993, and has examined pertinent maps,
drawings, and documents; and
WHEREAS, the City Council has made the following findings:
1. In adopting this Negative Declaration, the City Council
has relied on the staff analysis set out in Initial Study
93 -5, and the previously certified EIR for Harbor Bay
Isle (Harbor Bay Isle, A Residential and Industrial
Development on Bay Farm Island, City of Alameda, Prepared
by Arthur D. Little, dated November 3, 1973 -- Certified
by the City Council in 1974), in concluding that the
project does not have the potential to substantially
degrade the quality of the environment, substantially
reduce the habitat of a fish or wildlife species, cause
a fish and wildlife population to drop below self -
sustaining levels, threaten to eliminate a plant or
animal community, reduce the number or restrict the range
of a rare or endangered plant or animal, or eliminate
important examples of the major periods of California
history or prehistory.
2. The Initial Study identified no potentially significant
effects regarding the City's acquisition of the site and
the development of the soccer field(s), and there is no
substantial evidence before the City Council that the
project as currently proposed may have a significant
adverse effect on the environment. The certified EIR for
Harbor Bay Isle (1974), Planned Development 81 -2, and the
Development Agreement between the City and Harbor Village
Associates Four and Five and Harbor Bay Isle Associates
(1959), provide measures to mitigate the potential
effects to a point where clearly no significant adverse
effects would occur regarding the construction of a
business park building on this site consistent with
earlier approvals.
The project does not have the potential to achieve short
term, to the disadvantage of long term, environmental
goals because the acquisition of land and the soccer
field(s) are permitted uses and are appropriate uses
within the Business Park without any significant impact
to the existing or possible future land uses within the
Harbor Bay Business Park.
4 The project does not have possible environmental effects
which are individually limited but cumulatively
considerable, because the only change from the project
previously evaluated in the certified EIR is the City's
acquisition of the site and development of the soccer
field(s) which do not give rise to cumulative impacts.
The project does not have environmental effects which
will cause substantial adverse effects on human beings,
either directly or indirectly. The City's acquisition of
land and the development of soccer field(s) within a
developed business park where activities, such as a
soccer field and the proposed building for the University
of California San Francisco are permitted uses, will not
have a significant impact on the residential
neighborhoods of Harbor Bay Isle.
6. The changes in the project, specifically the City
acquisition of the site and the development of soccer
field(s), do not result in new significant environmental
impacts not considered in the 1974 certified EIR and the
1989 addendum. Therefore, there is no need for further
environmental analysis nor the imposition of additional
mitigations.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of
Alameda that the City Council hereby adopts Negative Declaration
IS -93 -5 with the following amendments:
a. Page 6 -- Letter F -2, First two sentences to read as
follows: "The soccer fields will be located within an
area subject to airport noise. The site is within the 65
CNEL noise contour which identifies those areas subject
to noise impacts of 65 CNEL or greater."
b. Page 6 -- Letter G, First sentence to read as follows:
"The project site is, located in a developed area with
street lighting; therefore, there is no significant
impact from the lighting of the soccer field.
c. Page 9 -- Letter M -2, Second paragraph, first sentence,
"Development of the site as a research facility is
consistent with the business park use evaluated in the
certified EIR prepared by Arthur D. Little_in 1974."
a Page 6 -- Letter M -2, Second sentence, " The proposed
soccer field(s) will require additional parking which can
be accomodated through a shared parking arrangement with
the adjacent office buildings."
e. Page 13 -- Determination, the first selection, "I find
that the proposed project could not have a significant
effect on the environment, and a NEGATIVE DELCARATION
will be prepared," should have been checked, instead of
the second selection.
