VACATING A PORTION OF MECARTNEY ROAD
ADJACENT TO 158 MAITLAND DRIVE
WHEREAS, on January 18, 1994, the City Council, by
Resolution No. 12494 stated an intention to vacate a portion of
Mecartney Road adjacent to 158 Maitland Drive; and
WHEREAS, the vacation proceeding has been conducted
pursuant to the provisions of the California Streets and Highways
Code, Division 9, Part 3, (General Vacation Procedures), and a
public hearing held; and
WHEREAS, a tentative agreement between the prospective
owner of 158 Maitland Drive and the City of Alameda has been made,
and
WHEREAS, utility companies have been notified of the
proposed vacation and their requests have been incorporated.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Alameda hereby approves the vacation of the subject
portion of Mecartney Road, described hereto as Exhibit A, on the
following terms and conditions:
(1) That the prospective adjacent property owner bear
the costs for the construction of curb, gutter and sidewalk along
the Mecartney frontage of said property.
BE IT FURTHER RESOLVED, that the City Clerk shall cause
a certified copy of this resolution of vacation, attested under
seal, to be recorded in the County Recorders Office once the
vacation is effective.
STREET VACATION OF A PORTION OF MECARTNEY ROAD
A portion of Mecartney Road described as follows:
A strip of land 12 feet in width adjacent to and southerly of the
southerly property line of that property known as 158
Maitland Drive, and more specifically described as follows:
COMMENCING at the intersection of the northerly line of Mecartney
Road and the southwesterly line of Maitland Drive as said
Road and Drive exist today;
THENCE North 59°00'20" West along said northerly line of
Mecartney Road 25.00 feet to the TRUE POINT OF BEGINNING;
THENCE North 59°00'20" West along said northerly line of
Mecartney Road 143.83 feet to the westerly line of said
property;
THENCE South 30°59'40" West 12.00 feet to a point on a line
parallel to and 12 feet from the northerly line of Mecartney
Road;
THENCE Sol:th 59°00'20" East along said parallel line 143.83 feet;
THENCE North 30°59'40" East to the TRUE POINT OF BEGINNING.
