Resolution 12534CITY OF ALAMEDA RESOLUTION NO. 12534 AMENDING MASTER FEE RESOLUTION NO. 12191 ESTABLISHING EMPLOYER TRIP REDUCTION FEES AND PENALTIES WHEREAS, the Alameda Municipal Code and the California Government Code provide that the City Council may set fees for reasonable cost of providing various services by resolution; and WHEREAS, the City Council, at the August 27, 1991 Special City council meeting, directed City staff to amend the Alameda Municipal Code to reflect that City fees shall be set by City Council resolution; and WHEREAS, Resolution No. 12191 ("Master Fee Resolution"), as amended, codifies existing fees for various City services and permits; and WHEREAS, the City Council has determined that the Employer Trip Reduction Fees and Penalties are reasonable for providing the service; and NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda, that the following rates, attached hereto as Exhibit A, be established as the Employer Trip Reduction Fees and Penalties. BE IT FURTHER RESOLVED that all fees established by Master Fee Resolution No. 12191 which are inconsistent with the fees established by this resolution are hereby repealed. BE IT FURTHER RESOLVED that all existing fees and terms contained in Master Fee Resolution No. 12191 not superseded by this Resolution shall remain in full force and effect. BE IT FURTHER RESOLVED that this Resolution shall not become effective until the effective date of the adoption of the required implementing Ordinance. EXHIBIT A EMPLOYER TRIP REDUCTION FEES AND PENALTIES Fines and penalties do not accrue on weekends and holidays officially observed by the City of Alameda. Employer Trip Reduction Plan Review Fee: $50 per plan submittal, or $250 per consolidated plan submittal for five or more work sites. Employer Trip Reduction Plan Appeal Fee: $50 for initial application and hearing. $25 for each subsequent hearing necessary to dispose of the appeal. PENALTY FOR LATE SUBMISSIONS: (1) Transit Marketing Center - $5/day (2) Annual Survey - $10/day (3) ETR Plan - $20/day (4) Registration $20/day (5) Parking Management Plan $20/day PENALTY STRUCTURE FOR NON-IMPLEMENTATION: $1/per employee/per day. Employees shall be defined as in subsection 8-29.1 and applicability to determine number of employees shall be pursuant to subsection 8- 29.4. NON ATTAINMENT FEE FOR FAILURE TO MEET FINAL PERFORMANCE OBJECTIVES: The fee shall be calculated by the following formula: (Attained VER - Required VER) x 10 x Full Meter Rate per Employee per work day Employees are defined as in section 8-29.1, and applicability to determine number of employees as set forth in subsection 8-29.4. FEES FOR SUBMITTAL OF APPEALS OR FEES AND PENALTIES: $50 for initial application and hearing. $25 for each subsequent hearing necessary to dispose of the appeal.
