Resolution 12561CITY OF ALAMEDA RESOLUTION NO. 12561 AUTHORIZING SUBLEASE AGREEMENT RENEWAL WITH BANK OF AMERICA NATIONAL TRUST AND SAVINGS FOR THE WASTE MANAGEMENT RECYCLING PROGRAM OFFICES AT 2411 SANTA CLARA AVENUE, ALAMEDA, CALIFORNIA WHEREAS, at the August 18, 1992 City Council meeting, by Resolution No. 12304, the City Council of the City of Alameda authorized the execution of a sublease for office space at 2411 Santa Clara Avenue for the Waste Management Recycling Program offices; and WHEREAS, the term of the sublease between the City of Alameda and Bank of America National Trust and Savings expires on August 31, 1994 but provides for renewal; and WHEREAS, the City of Alameda and Bank America National Trust desire to renew the sublease for the Waste Management Recycling Program for an additional year at a cost of $7,500 per year; and WHEREAS, funds for this purpose, have been budgeted in the 1994 -95 Fiscal Year budget for the Waste Management and Recycling Program. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby authorizes the Sublease Agreement renewal with Bank of America National Trust and Savings, a copy attached hereto as Exhibit A, for the Waste Management Recycling Program offices at 2411 Santa Clara Avenue, also known as 1500 - 1504 Park Street. BE IT FURTHER RESOLVED that the Mayor of the City of Alameda is hereby authorized to execute, for and on behalf of the City of Alameda, the renewal of the Sublease Agreement and the City Clerk is hereby authorized and directed to attest the same. EXTENSION OF SUBLEASE This Extension of Sublease is made as of this day of July, 1994, by and between Bank of America National Trust and Savings Association ( "Sublessor ") and City of Alameda Public Works Department ( "Sublessee ") in reference to that certain Agreement of Sublease dated July 1, 1992 (the "Sublease "). RECITALS A. Under the Sublease, Sublessor leased to Sublessee certain premises commonly known as 1500 Park Street, Suite 40, Alameda, California, for a term commencing on September 1, 1992, and expiring on August 31, 1993, with one option to renew the Sublease for a one year term, which option Sublessee exercised. B. The term of the Sublease, including all existing options to renew, will terminate on August 31, 1994. C. Sublessee wishes to extend the term of the Sublease for one year on the same terms and conditions, and Sublessor is willing to agree to such extension on condition that Sublessee agrees to perform all of its obligations under the Sublease. AGREEMENT The parties agree as follows: 1. The term of the Sublease is extended for an additional one year term commencing on September 1, 1994, and terminating on August 31, 1995, on all of the terms and conditions of the Sublease except Paragraphs 4, relating to the original term of the Sublease, and 19, relating to the expiring option to renew. In all other respects. the terms and conditions of the Sublease will remain in full force and effect.
