AMENDING MASTER FEE RESOLUTION NO. 12191
BY ESTABLISHING AN APPEAL PROCESSING FEE
FOR THE PURPOSE OF APPEALING DECISIONS OF
SUPERVISING ANIMAL CONTROL OFFICERS
WHEREAS, the Alameda Municipal Code and the California
Code provide that the City Council may set fees for reasonable cost
of providing various services by resolution; and
WHEREAS, the City Council, at the August 27, 1991 Special
City Council meeting directed City staff to amend the Alameda
Municipal Code to reflect that City fees shall be set by City
Council resolution; and
WHEREAS, Resolution No. 12191 ("Master Fee Resolution"),
as amended codifies existing fees for various City services and
permits; and
WHEREAS, the City Council, at the February 7, 1995 City
Council meeting, directed staff to establish an appeal processing
fee for the purpose of appealing decisions of the Supervising
Animal Control Officer; and
WHEREAS, the City Council has determined that the
proposed appeal fee is reasonable for providing municipal services.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the following appeal fee be established:
Appeal Processing Fee to Appeal Decision $100.00
of Supervising Animal Control Officer
BE IT FURTHER RESOLVED that pursuant to Ordinance No.
1928, the City fees are subject to administrative adjustments not
greater than 5% annually over the existing recovery levels.
BE IT FURTHER RESOLVED that all fees established by
Master Fee Resolution No. 12191 which are inconsistent with the
fees established by this resolution are hereby repealed.
BE IT FURTHER RESOLVED that this resolution shall not
become effective until the effective date of the adoption of
required implementing ordinance.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st day of
February , 1995, by the following vote to wit:
AYES: Councilmembers Arnerich, DeWitt, Lucas,
Mannix and President Appezzato - 5.
NOES: None.

ABSTENTIONS: None.
