Resolution 12654CITY OF ALAMEDA RESOLUTION NO. 12654 APPROVING A NEGATIVE DECLARATION, IS-95-3, FOR THE PERMANENT RELOCATION OF THE COMMUNITY DEVELOPMENT DEPARTMENT, A POLICE DEPARTMENT ANNEX, AND OFFICES OF THE WEST ALAMEDA BUSINESS ASSOCIATION TO 1701 WEBSTER STREET WHEREAS, an application was made by the City of Alameda for an Initial Study, IS-95-3, to determine the potential environmental effects that would be associated with a proposal to relocate temporarily the offices of the City of Alameda to the East Wing of the Historic Alameda High School, 2250 Central Avenue, and the permanent relocation of the Community Development Department, a Police Department Annex, and the offices of the West Alameda Business Association to 1701 Webster Street; and WHEREAS, a proposed Negative Declaration was circulated for public comment between April 21 and May 22, 1995, and no comments were received; and WHEREAS, the Alameda Planning Board held a public hearing on the proposed Negative Declaration on May 22, 1995, examined pertinent maps and documents and considered the testimony received during the public hearing; and WHEREAS, the Board determined that the amount of projected parking demand to be satisfied by on-street parking spaces was not realistic in light of the existing use of such spaces and that a mitigation measure requiring the City to secure an additional 25 off-street parking spaces for employee parking was necessary to reduce parking impacts to a less than significant level; and WHEREAS, the Board recommended to City Council approval of the Negative Declaration with the Board's changes; as set out in Planning Board Resolution PB-95-19; and WHEREAS, the City Council has reviewed the proposed Negative Declaration, examined pertinent documents, and considered the recommendation of the Planning Board; and WHEREAS, the Council has made the following findings: 1. The project does not have the potential to substantially degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish and wildlife population to drop below self- sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of the major periods of California history or prehistory because there are no known significant biological resources at 1701 Webster Street. 2. The project does not have the potential to achieve short term, to the disadvantage of long term, environmental goals because the project would be consistent with the City's General Plan; and the relocation of the Community Development Department and other offices to 1701 Webster Street would help to revitalize an older commercial district. 3. The project does not have possible environmental effects which are individually limited but cumulatively considerable because the project would not affect any known significant environmental resources. 4. The project does not have environmental effects which will cause substantially adverse effects on human beings, either directly or indirectly, because there would be no increase in earthquake or other natural hazards as a result of the project and any hazardous materials which remain, such as asbestos or lead paint, would be removed as part of the remodeling process. THEREFORE BE IT RESOLVED that the City Council of the City of Alameda hereby determines that Negative Declaration, IS-95-3, contains adequate information to review the project and determines that there will be no potentially significant effects on the environment and hereby adopts the Negative Declaration with respect to the relocation of the Community Development Department, a Police Department Annex and offices of the West Alameda Business Association to 1701 Webster Street. NOTICE. No judicial proceedings subject to review pursuant to California Code of Civil Procedure Section 1094.5 may be prosecuted more than ninety (90) days following the date of final action by the City Council plus extensions authorized by California Code of Civil Procedure Section 1094.6. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 6th day of June , 1995, by the following vote to wit: AYES: Councilmembers Arnerich, DeWitt and Mannix - 3.
