Resolution 12658CITY OF ALAMEDA RESOLUTION No. 12658 OPPOSING ASSEMBLY BILL 318 PROHIBITING TRANSFERS FROM THE ALAMEDA'S BUREAU OF ELECTRICITY TO THE CITY'S GENERAL FUND WHEREAS, Assembly Bill 318, introduced by Senator Richard Katz, restricts rate setting authority of municipal water and power agencies; and WHEREAS, Assembly Bill 318 is an intrusion into the rate setting authority of local utilities; and . WHEREAS, Assembly Bill 318 would have a devastating impact on local budgets; and WHEREAS, Assembly Bill 318 infringes on the constitutionally guaranteed home rule of charter cities; and WHEREAS, City Charter Section 12-6 approved by City voters in 1937 (58 years ago) authorized the tranfer of funds from T the Bureau of Electricity to the City's General fund; and WHEREAS, Assembly Bill 318 prohibits transfers from Alameda's Bureau of Electricity to the City's General Fund unless this has been approved by the voters within the last 50 years; and WHEREAS, residents of Alameda would lose approximately 10% of the City's budget which would force tax increases or cuts in City of Alameda programs; and WHEREAS, AB 318 was passed by the State Assembly and is currently before the State Senate Committees on Local Government and Agriculture and Water Resources. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the Council's opposition to AB 318 be made known to all members of the State Assembly and State Senate who have influence over these bills. BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the State Senator Nicholas Petris, Assemblywoman Barbara Lee and Assemblyman Richard Katz and the League of California Cities.
