Resolution 12693CITY OF ALAMEDA RESOLUTION NO. 12693 AUTHORIZING THE CITY MANAGER TO EXECUTE CERTAIN GUARANTEES IN CONNECTION WITH THE LEASE OF PROPERTY AT THE NAVAL AIR STATION WHEREAS, the Alameda Reuse and Redevelopment Authority (ARRA) is negotiating with a number of prospective tenants and the United States Navy concerning the use of certain property at the Naval Air Station Alameda; and WHEREAS, several issues have arisen in the negotiations that may need to be resolved by the City of Alameda; and WHEREAS, it is in the interest of the City to facilitate use of property at the Naval Air Station in order to mitigate the adverse impacts of closure of that facility; and WHEREAS, the economic recovery of the Alameda community would be enhanced significantly if civilian uses are established at the base because of the potential of such uses to create jobs that could be filled by Alameda residents and to generate sales tax revenue to support City services needed as a result of the base closure. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby authorizes the City Manager, when the City Manager deternines that it is in the City's interest to do so, to execute documents in a form approved by the City Attorney to provide guarantees to tenants at the Naval Air Station to address the following: (1) assume the duties and obligations of the ARRA should the ARRA cease to exist during the term of the lease; and (2) provide utility service at commercially reasonable rates if utility services at such rates are not otherwise available to a tenant following cessation of utility service from the U.S. Navy. BE IT FURTHER RESOLVED that the City Manager may include in the guarantee documents authorized herein those terms and conditions the City Manger considers necessary and appropriate to meet the interests of the City. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in adjourned regular meeting assembled on the 9th day of October , 1995, by the following vote to wit: AYES: Councilmembers Arnerich, DeWitt, Lucas, Mannix and President Appezzato - 5.
