Resolution 12694RECORDING REQUESTED BY: CITY OF ALAMEDA WHEN RECORDED MAIL TO: City Clerk's Office City Hall, Room 315 2263 Santa Clara Avenue Alameda, CA 94501 CITY OF ALAMEDA RESOLUTION NO. 12694 TERMINATING THE REGULATORY AGREEMENT BETWEEN THE CITY OF ALAMEDA AND THE HOUSING AUTHORITY OF THE CITY OF ALAMEDA RELATED TO THE DEVELOPMENT OF TWELVE UNITS OF SENIORS HOUSING AT 2201 SANTA CLARA AVENUE WHEREAS, the Housing Authority of the City of Alameda was interested in developing twelve (12) units of seniors housing at 2201 Santa Clara Avenue, Alameda, California (more particularly described in Exhibit A attached hereto and incorporated herein by this reference) (hereinafter, the "Property "); and WHEREAS, the Housing Authority of the City of Alameda and the City of Alameda entered into a Regulatory Agreement for the use of HOME Funds for such development which was recorded against the Property; and WHEREAS, the Housing Authority Board of Commissioners have determined that the project is no longer financially feasible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that: 1. The Regulatory Agreement between the City of Alameda and the Housing Authority of the City of Alameda entered into on March 15, 1994 and amended on January 3, 1995 is hereby terminated; 2. Any and all use restrictions arising from this agreement are removed from the Property, more particularly described in Exhibit A attached hereto; and 3. The City Manager is authorized to execute all required documents. EXHIBIT "A" The land referred to herein is situated in the County of Alameda, City of Alameda, State of California, and is described as follows: Beginning at a point of intersection of the Northern line of Santa Clara Avenue, as the same now exists since the widening thereof, with the Eastern line of Walnut Street, as said Street is shown on the Map herein ref erred to, and running thence easterly along said line of Santa Clara Avenue, 70 feet; thence Northerly and parallel with said line of Walnut Street 107 feet; thence Westerly and parallel with said line of Santa Clara Avenue 70 feet to said eastern line of Walnut Street; thence Southerly along said line of Walnut Street 107 feet to the point of beginning. Being a portion of Lots 1 and 2 in Block 34, as said lots and Bloc: are shown upon that certain Map entitled "Map of Land Adjacent to the town of Encinai, Alameda County, Cal. ", filed May 28, 1867 in Book 19 of Maps, page 53, in the office of the County Recorder of Alameda County. Assessor's Parcel No.: 071- 0219 -012 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 27th day of October , 1995, by the following vote to wit: AYES: Councilmembers Arnerich, DeWitt, Lucas, Mannix and President APpezzato - 5.
