DECLARING THE INTENTION OF THE CITY COUNCIL TO FORM AN
ASSESSMENT DISTRICT TO FUND CONSTRUCTION OF A NEW MAIN LIBRARY
BUILDING ON THE LINOAKS SITE AND TO REHABILITATE AND
SEISMICALLY UPGRADE THE CARNEGIE BUILDING FOR USE AS A MUSEUM
OR OTHER PUBLIC PURPOSE IF THE VOTERS OF THE CITY APPROVE THE
MEASURE TO AMEND SUBSECTION 26-1.1 OF THE ALAMEDA MUNICIPAL
CODE
WHEREAS, Chapter XXVI of the Alameda Municipal Code ("the
Municipal Code") provides a method for financing public
improvements in the City through the use of assessment district
proceedings; and.
WHEREAS, the Municipal Code presently provides no description
of the public improvements that can be funded through assessment
district proceedings and relies upon the general law in the State
of California, both statutory and case law, to define what
improvements are permissibly constructed by a charter city through
exercise of its charter city power to form such districts to
accomplish public purposes; and
WHEREAS, the City Council wishes to provide a mechanism by
which the voters of the City, in a binding election, can express
their opinions upon a proposal to construct a new main library on
the Linoaks site and to rehabilitate and seismically upgrade the
Carnegie Building according to the Secretary of the Interior's
Standards for Rehabilitation and the Feasibility Study prepared by
Bull, Stockwell, Allen & Ripley dated August 4, 1994 for use as a
museum or other public purpose and the City Council has determined
that an appropriate method to do so is to amend the Municipal Code
provisions regarding assessment districts to mention library and
museum improvements explicitly; and
WHEREAS, the City Council intends the vote on the Municipal
Code amendment to serve as a community plebiscite on whether the
voters support paying for a new main library and rehabilitation of
the Carnegie to be used as a museum or other public purpose through
assessments levied upon real property within the City; and
WHEREAS, it is the intention of the City Council to form an
assessment district to fund construction of a new main library on
the Linoaks site and to rehabilitate and seismically upgrade the
Carnegie Building for use as a museum or other public purpose if
the Measure amending the Municipal Code is approved by the .voters
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALAMEDA as follows:
If the Measure to amend subsection 26-1.1 of the Municipal
Code to provide explicit authority to form assessment districts for
the purpose of funding public library and museum improvements and
services, submitted to the voters at the special election called
during this meeting of the City Council, is approved by the voters,
the City Council hereby declares its intention to form such an
assessment district to provide for building a new main library on
the Linoaks site and to rehabilitate and seismically upgrade the
Carnegie Building according to the Secretary of the Interior's
Standards for Rehabilitation and the Feasibility Study prepared by
Bull, Stockwell, Allen & Ripley dated August 4, 1994 for use as a
museum or other public purpose by levying an annual benefit
assessment on residential parcels of not more than $68.50 and a
proportionate annual assessment on non-residential properties for
up to 30 years. Said assessment district shall provide separate
construction accounts for the new main library and the Carnegie
Building rehabilitation and seismic upgrade and shall allocate
monies collected through the assessment district to each account in
the proportion of 82.21 %. for the new main library account and
17.78%- to the Carnegie Building account.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 19th
day of December , 1995, by the following vote to wit:
AYES: Councilmembers Arnerich, DeWitt, Lucas,
Mannix and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSENTENTIONS: None.
