Resolution 12744CITY OF ALAMEDA RESOLUTION NO. 12744 APPROVING THE UNDERTAKING OF CERTAIN PUBLIC IMPROVEMENTS ON BEHALF OF THE COMMUNITY IMPROVEMENT COMMISSION WHEREAS, the Community Improvement Commission of the City of Alameda (the "CIC ") is carrying out the Plan of the West End Community Improvement Project ( "WECIP" or the "Project "); and WHEREAS, Section 33445 of the Community Redevelopment Law (Health and Safety Code section 33000 et seq.) provides that the CIC may, with the City Council of the City of Alameda's (the "Council's ") consent, pay for all or part of the value of the land for and the cost of the installation and construction of any building, facility, structure or other improvements which are publicly owned either within or outside the boundaries of the WECIP if the CIC and the Council make certain findings; and WHEREAS, Section V.F.2 of the Plan authorizes the CIC to install and construct public improvements either within or outside the WECIP Area; and WHEREAS, the CIC wishes the City to make transportation improvements to the intersection of West Campus Drive and Atlantic Avenue (the "Intersection "), in order to provide safe and efficient traffic flow improvements (the "Improvements "); and WHEREAS, the Improvements were included in the CIC Implementation Plan adopted December 6, 1994 pursuant to Health and Safety Code section 33490. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby resolves as follows: Section 1. The City Council hereby finds and determines that the Improvements are of benefit to the Project Area and the immediate neighborhood in which the Project is located, and that no other reasonable means of financing the Improvements are available to the community. This finding is supported by the following facts: (a) The Intersection currently induce hazardous and inefficient traffic /pedestrian conditions; (b) The Improvements shall greatly improve the safety and efficiency of the Intersection, and therefore benefit the Project Area; (c) The City does not have sufficient permanent funds to undertake the Improvements. Section 2. The City Council hereby approves the undertaking by the City of the Improvements based upon the agreement by the CIC to reimburse the City for a portion of the costs of Improvements. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 5th day of Marsh , 1996, by the following vote to wit: AYES: NOES: ABSENT: Councilmembers DeWitt, Lucas, Mannix and President Appezzato - 4.
