IN WITNESS, WHEREOF, I have hereunto set my hand and affixed the official seal of said City this 6th day of March , 1996. // Dia T= B Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12746 DENYING AN APPEAL OF A HISTORICAL ADVISORY BOARD'S DENIAL OF HSBL-96-1 TO REMOVE 1715 PARK STREET FROM THE HISTORIC BUILDING STUDY LIST WHEREAS, Patrick Ellwood made an application on behalf of James and Michael Bradford; and WHEREAS, the application was complete on November 30, 1995; and WHEREAS, the General Plan designation for the site is Community Commercial; and WHEREAS, the Zoning Ordinance classification for the site is C-M (Commercial Manufacturing); and WHEREAS, the Historical Advisory Board held public hearings to consider the application on December 14, 1995 and January 4, 1996 N„, and upon due consideration denied the application; and WHEREAS, an appeal was made on January 17, 1996 by Patrick Ellwood to the City Council of the denial by the Historical Advisory Board of the application to remove the property from the Historic Building Study List; and WHEREAS, the City Council held a public hearing on this appeal on March 5, 1996, and examined pertinent maps, drawings and documents; and WHEREAS, the City Countil finds that this proposal is not defined as a project in accordance with article 20, definitions of the CEQA Guidelines; and WHEREAS, the City Council made the following findings: 1. The property retains some of its exterior historic fabric, specifically the second story facade is an excellent example of Italianate Commercial Storefront. 2. The building is the only remaining example of its kind in the block. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby denies the appeal. Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12747 SUPPORTING ASSEMBLY BILL 2828 REQUIRING THE RETURN OF A PORTION OF SURPLUS STATE REVENUES TO CITIES AND COUNTIES TO REPAY FOR PROPERTY TAX LOSSES WHEREAS, since 1992, State Government has diverted hundreds of millions of dollars in property taxes away from cities and counties to balance the State Budget; and WHEREAS, the League of California Cities data indicates that the losses for the City of Alameda are more than $2.5 million per year; and WHEREAS, the State's decision to deprive cities of property taxes needed for vital local services constitutes a shortsighted and counterproductive policy; and WHEREAS, there is an indication that the recession is now over and Sate revenues are growing; and WHEREAS, Assembly Bill 2828 (Sweeney), commencing with the 1995-96 fiscal year, will require that on an annual basis a percentage of surplus state revenues shall be returned to cities and counties to repay property tax losses. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby supports Assembly Bill 2828 and any other legislation that would require the return of a portion of surplus State revenues to cities and counties to repay for property tax losses. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to forward a Certified Copy of this Resolution to Assemblymember Sweeney, Assemblymember Lee, Susan Hammer, Mayor, City of San Jose, League of California Cities and Independent Cities Association. Felsch, City Clerk City of Alameda CITY CF ALAMEDA RESOLUTION 12748 ADOPTING PENAL CODE SECTION 597.1 RELATING TO THE IMPOUNDING OF NEGLECTED AND ABANDONED ANIMALS WHEREAS, the provisions of Penal Code section 597(f) relating to the impounding of neglected and abandoned animals and placing a lien thereon has been declared unconstitutional; and WHEREAS, the legislature adopted Penal Code section 597.1 which provides for notice and hearing before imposing a lien and disposing of animals taken into custody by the City of Alameda; and WHEREAS, the City of Alameda has no effective method of dealing with sick and neglected animals taken into possession and maintained by the City; and WHEREAS, subdivision (1) of Penal Code section 597.1 is operative in any city which chooses to be governed by its provisions, in lieu of Penal Code section 597(f). Diane Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12749 AUTHORIZING OPEN MARKET PURCHASE OF A MODULAR AMBULANCE FOR THE FIRE DEPARTMENT WHEREAS, the Alameda Fire Department has provided a Basic LIFE Support Emergency Ambulance Transport Program since August 25, 1984; and WHEREAS, the best vehicle for augmenting the Basic Life Support Emergency Ambulance Transport Program is a new 1996 Ford E- 350XL, Tye III, Wheeled Coach, modular ambulance; and. WHEREAS, in accordance with Section 3-15 of the City Charter, the Council may determine that great necessity requires immediate action and thereupon proceed to purchase such supplies in the open market; and WHEREAS, great necessity exists to acquire the 1996 Ford E-350XL, Type III, Wheeled Coach, modular ambulance, enabling the City cf Alameda to maintain the present high level of ambulance service, and compatibility with other equipment; and WHEREAS, Section 3-15 of the City Charter provides that the City Council, by four affirmative votes, can authorize an open market purchase if it determines that the materials or supplies can be purchased at a lower price in the open market; and. WHEREAS, the City Council has determined that the 1996 Ford. E-350XL, Type III, Wheeled Coach ambulance is the best option for the City and can be obtained at considerable savings to the City on the open market; and WHEREAS, the ambulance vehicle is needed as soon as possible to serve the citizens of the community with an adequate fleet of first-line and reserve ambulances; and WHEREAS, there are sufficient funds in the Apparatus Replacement Fund and the Fire Department operational budget for the purchase of a Type III ambulance. NOW, THEREFORE EE IT RESOLVED by the Council of the City of Alameda, by four affirmative votes, that the Fire Chief or his authorized representative is hereby authorized to purchase one 1996 Ford E-350XL, Type III modular ambulance offered by Wheeled Coach Ambulance, at the all inclusive cost of $72,472.33 or less in the open market without formal bidding procedures.
