Resolution 12757CITY OF ALAMEDA RESOLUTION NO. 12757 DECLARING CANVASS OF RETURNS AND RESULTS OF SPECIAL MUNICIPAL ELECTION HELD MARCH 26, 1996 WHEREAS, pursuant to Article XIX of the City Charter of the City of Alameda (the "Charter "), a Special Municipal Election was consolidated and held with the Statewide Primary Election on March 26, 1996, for the purpose of submitting to the qualified electors of the City of Alameda certain proposals, as set forth hereinafter: MEASURE C Shall an ordinance be adopted forming a citywide assessment district to provide funds to build a new main library and to rehabilitate and seismically upgrade the Carnegie Building for use as a museum or other public purpose through the levy of an annual assessment that shall not exceed $68.50 on residential properties and a proportionate annual assessment on non - residential properties for up to 30 years? MEASURE D Shall the Charter of the City of Alameda be amended to require newspapers to be adjudicated as a newspaper of general circulation within the City of Alameda to qualify to publish the City's legal advertisements in lieu of the current Charter requirements that a newspaper have been published for at least one year in the City and that it have a bona fide paid circulation of at least one thousand copies? WHEREAS, a Notice of the Measures, certified by the City Clerk, was duly issued and published in the official newspaper of said City in the manner and time prescribed by law; and WHEREAS, all of the ballots used for said election were prepared, as to form and content, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten days preceding the date of said election; and WHEREAS, the Registrar of Voters for the County of Alameda has canvassed the votes for the City of Alameda and has certified the results to the City Clerk. NOW, THEREFORE, BE IT RESOLVED and declared by the City Council of the City of Alameda as follows: Section 1. The Special Municipal Election was consolidated with the Statewide Primary Election held on March 26, 1996, and the election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. Section 2. The total number of ballots cast in the City of Alameda at the election was 17,494. Section 3. The total number of votes cast in the City of Alameda at the election for the aforementioned Measures was as follows: Measure C Measure D Yes: 7,067 No: 9,375 Yes: 8,867 No: 5,998 BE IT FURTHER RESOLVED AND DECLARED that the Measure C, having received a majority of the number of "No" votes cast, was, and is hereby declared NOT PASSED; and that the Measure D, having received a majority of the number of "Yes" votes cast, was, and is hereby declared PASSED. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 16th day of April , 1996, by the following vote to wit: AYES: NOES: Councilmembers Arnerich, DeWitt, Lucas, Mannix and President Appezzato - 5.
