CITY OF ALAMEDA RESOLUTION NO. 12776
ORDERING VACATION OF POWER EASEMENTS WITHIN.
LOT 111 AND LOT 147 OF TRACT 6111 AND
ESTABLISHING NEW POWER EASEMENTS
WITHIN LOT 111 AND LOT 147 OF TRACT 6111
WHEREAS, subject easements were dedicated to the City of
Alameda on the Final Map of Tract 6111 on November 7, 1989 per City
of Alameda Resolution No. 11870, filed in the Office of the County
of Alameda Recorder on December 15, 1989, Recorder's Series No. 89-
338720, Book 188 of Maps, Pages 45-54; and
WHEREAS, the City Council approved amendments to the
development agreement and ownership change from Harbor Bay Village
V Associates to Greystone Homes on November 14, 1994 per City of
Alameda Resolution No. 12585; and
WHEREAS, Greystone Homes, subdivider, has requested that
new easements be accepted; and
WHEREAS, the subject power easements as dedicated on the
Final Map of Tract 6111 now conflict with residential locations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that it is hereby ordered that the easements over
Lot 111 and Lot 147 of Tract 6111 be vacated pursuant to the
provisions of Chapter 4, Part 3, Division 9, Section 8333(c) of the
Streets and Highways Code and that new easements be accepted over
Lot 111 and Lot 147 of Tract 6111.
BE IT FURTHER RESOLVED that the City Clerk shall cause
certified copies of this resolution, attested under seal, to be
recorded in the County Recorder's Office and from and after the
date of this resolution is recorded, said portion of the power
easements established under the Final Map of Tract 6111 for Lot 111
and Lot 147 as recorded on November 7, 1989 no longer shall
constitute easements.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 18th
day of June , 1996, by the following vote to wit:
AYES: Councilmembers Arnerich, DeWitt, Lucas, Mannix
and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSENTENTIONS: None.
