ADOPTING NEGATIVE DECLARATION, IS 96-04, FOR INSTALLATION
OF IMPROVEMENTS WITHIN THE EXISTING TILDEN WAY RIGHT-OF-
WAY FROM PARK STREET TO THE ALAMEDA CITY LIMITS AND
ACROSS THE MILLER-SWEENEY (FRUITVALE) BRIDGE TO ALAMEDA
AVENUE IN OAKLAND
WHEREAS, an application was made by the City of Alameda Public
Works Department for an Initial Study, IS 96-04, to determine the
potential environmental effects of a proposal to complete curbs,
gutters, paths including sidewalks and median landscaping in Tilden
Way from Park Street to the Alameda City Limits and across the
Miller-Sweeney Bridge to Alameda Avenue in Oakland, with creation
of a cul-de-sac at Eagle Avenue, and with installation of a partial
Bridge soundwall, improved handicap access, and replacement of 22
historic streetlights with replicas; and
WHEREAS, a proposed Negative Declaration was circulated for
public comment between May 10, 1996 and June 10, 1996, and to the
State Clearinghouse (file number 96052056); and
WHEREAS, the proposal implements the General Plan, in
particular the Circulation Element; and
WHEREAS, adjacent properties are zoned for residential and
commercial uses; and
WHEREAS, Tilden Way is partially within the Business and.
Waterfront Improvement Project and is consistent with the Community
Improvement Plan (CIP) of the BWIP; and.
WHEREAS, no written comments were received within the public
comment period nor at the June 10, 1996 Planning Board meeting; and
WHEREAS, the Planning Board held a public hearing on this
Negative Declaration on June 10, 1996, and examined pertinent maps,
drawings, and documents and recommended to the City Council the
adoption of the Negative Declaration; and
WHEREAS, the City Council has held a public hearing on this
Negative Declaration on June 18, 1996, and has examined pertinent
maps, drawings, and documents and has considered written comments
and testimony received during the public hearing; and
WHEREAS, the City Council has made the following findings:
1. The project does not have the potential to substantially
degrade the quality of the environment, substantially
reduce the habitat of a fish or wildlife species, cause
a fish and wildlife population to drop below
self-sustaining levels, threaten to eliminate a plant or
animal community, reduce the number or restrict the range
of a rare or endangered plant or animal, or eliminate
important examples of the major periods of California
history or prehistory because the route does not cover
with new displacement any wildlife habitat or historical
or prehistorical resources, since the project would be
confined to the existing street right-of-way and would
only reconstruct existing improvements.
2. The project does not have the potential to achieve short
term, to the disadvantage of long term environmental
goals because none of the physical changes .will be
sufficiently different from present conditions to
interfere with long term environmental goals.
3. The project does not have possible environmental effects
which are individually limited but cumulatively
considerable, because nearly all of effects related to
the roadway have already occurred, with acquisition and
development of Tilden Way several decades in the past.
4. The project does not have environmental effects which
will cause substantially adverse effects on human beings,
either directly or indirectly because the changes do not
restrict the traveled way of Tilden Avenue and because
the design enhances pedestrian and handicap access.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the City Council hereby adopts Negative Declaration,
IS 96-04.
NOTICE. No judicial proceedings subject to review pursuant to
California Code of Civil Procedure Section 1094.5 may be prosecuted
more than ninety (90) days following the date of the City Council
action on this matter plus extensions authorized by California Code
of Civil Procedure Section 1094.6.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 18th
