Resolution 12841CITY OF ALAMEDA RESOLUTION NO. 12841 AMENDING MASTER FEE RESOLUTION NO. 12191 REGARDING APPEAL FEES AND DEVELOPMENT FEE PAYMENTS WHEREAS, the City of Alameda Planning Board initiated a Zoning Text Amendment to delete the fee waiver process; and WHEREAS, present appeal fees in the Master Fee Resolution may be an impediment to appellants who are not the project sponsors and invite fee waiver requests; and WHEREAS, the Alameda Municipal Code and the California Government Code provide that the City Council may set fees for reasonable cost of providing various services by resolution; and WHEREAS, the City Council, at the August 27, 1991 Special City Council meeting directed City staff to amend the Alameda Municipal Code to reflect that City fees shall be set by City Council resolution; and WHEREAS, Resolution No. 12191 ("Master Fee Resolution"), as amended codifies existing fees for various City services and permits; and WHEREAS, the City Council has determined that the proposed fees are reasonable for providing municipal services. WHEREAS, the City Council has found that the project is Statutorily Exempt under Section 15061(b) (3) of the CEQA Guidelines, because "it can be seen with certainty that there is no possibility the activity in question may have a significant effect on the environment;" and WHEREAS, the City Council held a public hearing on this application on November 19, 1996, and examined pertinent maps, drawings, and documents; and WHEREAS, the Council has made the following findings: 1. The proposed amendment will have no effect upon the integrity of the General Plan as the Master Fee Resolution does not affect any policies in the General Plan. 2. The reduction in appeal fees and new administrative procedures for development fees will favorably affect the general welfare of the community by assisting the citizenry in participating in the development review process. EXHIBIT "A" PLANNING DEPARTMENT 1996 FEES 1. Reduce the Appeal Fee, as follows: APPEALS Appeal to the Planning Board 2C3.00 100.00 flat Appeal to the City Council 3G8.00 100.00 flat Appeal fees shall be returned to the appellant if the appellant is successful in the appeal and the appellant is not the property owner or applicant. MISCELLANEOUS 2. Add the following new fee to the "Miscellaneous" Section: Preparation of a fee installment T & M or deferral agreement 1 Hour minimum 3. Add a new section to the Planning Section of the Master Fee Resolution, as follows: Waiver, Deferral or Installment Payment of Fees The City Manager may approve the following: a. payment of the development fees on an installment basis, subject to the applicant entering into an agreement which provides for payment schedules, interest, and security. b. allow the payment of the fees to be deferred, subject to interest and adequate security, such as recording them as a lien against the property. c. a fee reduction where the application is a resubmission and a finding is made that the staff work involved would be less than other comparable applications and warrants reduced fees because there is less staff work involved. 3. The amendment to the Master Fee Resolution will create an equitable implementation of development review fees. NOW, THEREFORE, BE IT RESOLVED that the City Council approve an amendment to Exhibit "A" of the Master Fee Resolution to amend appeal fees and provide additional administrative procedures regarding development fees as provided for in Exhibit "A" to this resolution.
