AUTHORIZING OPEN MARKET PURCHASE OF
FIVE HARLEY-DAVIDSON MOTORCYCLES
FROM BOB DRON HARLEY-DAVIDSON, INC.
WHEREAS, the replacement of three motorcycles is
authorized in the 1996-97 police budget and the purchase of two
additional motorcycles is mandated as part of a grant recently
received from the State of California, Office of Traffic Safety
(OTS); and
WHEREAS, sufficient funds are available through the OTS
Grant and the current fiscal year budget appropriation; and
WHEREAS, Harley-Davidson police motorcycles are the best
police class equipment available to the City at this time and meet
or exceed all of the 1997 State of California General Services
Administration Specifications; and
WHEREAS, to maintain a safe fleet of dependable
motorcycles for local traffic enforcement and to implement programs
mandated by the OTS grant, it is necessary to purchase five police
motorcycles this year to replace aging equipment; and
WHEREAS, the City mechanic recommends purchase of the
five Harley-Davidson motorcycles in order to ensure compatibility
with the tools and parts currently used by the City garage; and
WHEREAS, Section 3-15 of the City Charter provides that
the City Council, by four votes, can authorize an open market
purchase if it determines that the materials or supplies can be
purchased at a lower price in the open market, or that great
necessity or emergency requires immediate action; and
WHEREAS, the City Council has determined that all other
practical alternatives were examined and that the Harley-Davidson
police motorcycles are the best option for police class equipment
available to the City of Alameda at this time which can be
purchased at the lowest price available through an open market
purchase directly from Bob Dron Harley-Davidson, Inc.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that pursuant to Section 3-15 of the City Charter, and
by four votes, the City Council hereby authorizes the Police Chief
or his authorized representative to purchase five Harley-Davidson
police motorcycles from Bob Dron Harley-Davidson Motorcycles, Inc.
of Oakland at a cost of $12,591.76 per motorcycle, including tax
and options.

I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 17th
day of December , 1996, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas
and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
