ORDERING THE VACATION OF PUBLIC UTILITY EASEMENTS
AND ACCEPTANCE OF NEW PUBLIC UTILITY EASEMENTS
WITHIN LOTS 8, 10, 29, 43, 52, AND 68
OF TRACT 6226 (VILLAGE V, HARBOR BAY ISLE)
WHEREAS, subject easements were dedicated to the City of
Alameda on the Final Map of Tract 6226 on May 15, 1990 per City of
Alameda Resolution No. 11964, filed in the Office of the County of
Alameda Recorder-on September 17, 1990, Recorder's Series No. 90-
248054, Book 193 of Maps, Pages 16 -22 and
WHEREAS, the City Council approved amendments to the
development agreement and ownership change from Harbor Bay Village
V Associates to Shea Homes on May 8, 1996 per City of Alameda
Resolution No. 12760; and
WHEREAS, Shea Homes, subdivider, has requested that new
easements be accepted; and
WHEREAS, the subject public utility easements as
dedicated on the Final Map of Tract 6226 now conflict with
residential locations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that it is hereby ordered that the easements over
Lots of Tract 6226 be vacated pursuant to the provisions of Chapter
4, Part 3, Division 9, Section 8333(c) of the Streets and Highways
Code and that new easements be accepted over Lots of Tract 6226.
BE IT FURTHER RESOLVED that the City, Clerk shall cause
certified copies of this resolution, attested under seal, to be
recorded in the County Recorder's Office and from and after the
date of this resolution is recorded, said portion of the public
utility easements established under the Final Map of Tract 6226 for
Lots as recorded on September 17, 1990 no longer shall constitute
easements.

Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 18th
day of February , 1997, by the following vote to wit:

NOES: None.

ABSTENTIONS: None.
