Resolution 12923CITY OF ALAMEDA RESOLUTION NO. 12923 APPROVING THE UNDERTAKING OF CERTAIN PUBLIC IMPROVEMENTS ON BEHALF OF THE COMMUNITY IMPROVEMENT COMMISSION WHEREAS, the Community Improvement Commission of the City of Alameda (the "CIC ") is carrying out the Plan of the Business and Waterfront Improvement Project ( "BWIP ") (the "Project "); and WHEREAS, Section 33445 of the Conununity Redevelopment Law (Health and Safety Code section 33000 et seq.) provides that the CIC may, with the City Council of the City of Alameda's consent, pay for all or part of the value of the cost of the land for and the cost of the installation and construction of any building, facility, structure or other improvements which are publicly owned either within or outside the boundaries of the BWIP if the CIC and Council make certain findings; and WHEREAS, the City wishes to make transportation improvements to Park Street to enhance pedestrian safety. WHEREAS, the City Council of the City of Alameda finds that: 1. The improvements are of benefit to the Project Area and the neighborhood in which the Project is located; ediate 0 2. No other reasonable means of financing the improvements are available to the m community because: a) Park Street currently exhibits a higher than normal accident rate and suffers from inefficient traffic /pedestrian conditions; b) The improvements shall improve the safety and efficiency of the intersection, and therefore benefit the Project Area; and 3. The improvements will assist in the elimination of one or more blighting conditions within the BWIP project area by helping to enhance pedestrian safety at unsignalized crosswalks in the BWIP project area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that based on the above findings, said Council hereby approves the improvements and that based upon the June 19, 1991 Cooperation Agreement between the City of Alameda and the Community Improvement Commission, a copy of which is on file in the Office of the City Clerk, the City shall be reimbursed by the Community Improvement Commission for a portion of the costs of the improvements. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 2nd day of September , 1997, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas and President Appezzato - 5.
