Resolution 12933CITY OF ALAMEDA RESOLUTION NO. 12933 APPROVING GENERAL PLAN AMENDMENT, GPA- 97 -01, POLICIES 2.8.B AND 2.8.0 AND RELATED GENERAL PLAN TEXT AND TO REALIGN THE BAY TRAIL BY AMENDMENT OF THE PARKS AND OPEN SPACE DESIGNATION ON THE GENERAL PLAN DIAGRAM FOR PROPERTIES LOCATED AT 2020 SHERMAN STREET, ENCINAL TERMINALS BERTH 5. WHEREAS, an application was made on May 5, 1997 by Wind River Systems requesting a General Plan Amendment relating to approval for development of approximately 371,000 square feet of space in five office and/or research and development buildings located on the Oakland— Alameda Estuary, on the west side of Alaska Basin, northeast of the point where Atlantic Avenue ends and feeds into Sherman Street. The net land area consists of about 20.4 acres (within a 32.225 —acre site; about 11.8 acres are submerged); and WHEREAS, the applicant is requesting a General Plan Amendment to change the land use policies for the project site from port use in order to be consistent with the "San Francisco Bay Area Seaport Plan", referred to hereafter as "Seaport Plan" designation by amendment to Policies 2.8b, 2.8.c; and related General Plan text and to realign the designation of a public open space trail on the General Plan Diagram; and WHEREAS, the proposal for a General Plan Amendment is part of an application which also includes a Rezoning, a Planned Development and a Development Agreement; WHEREAS, the westerly portion of the subject property is located in a M -1 -PD, Intermediate Industrial (Manufacturing), Planned Development Zoning District; the easterly portion is located in a M -2, General Industrial (Manufacturing) District; and the water portion north of the site is located in an E, Estuary Zoning District; and the applicant has requested a rezoning of the land and the westerly half of the Alaska Basin water area of the site to Commercial Manufacturing (C -M) Zoning District with a Planned Development (PD) Overlay, and WHEREAS, the application was accepted as' complete on July 18, 1997, and plan revisions were accepted on August 18, 1997 and; WHEREAS, the subject property is designated General Industry with a Parks and Public Open Space Corridor on the General Plan Diagram; and WHEREAS, on September 16, 1997 the City Council of the City of Alameda considered Mitigated Negative Declaration, IS -97 -2 with Mitigation Monitoring Program and findings and adopted the Mitigated Negative Declaration and Mitigation Monitoring Program; and WHEREAS, the Planning Board held a public hearing on this application on August 28, 1997, and examined pertinent maps, drawings, and documents in connection with the application; and recommended to the City Council approval of the General Plan Amendment; and WHEREAS, on September 16, 1997 the City Council of the City of Alameda held a public hearing on this application and examined pertinent maps, drawings and documents in connection with the application; and approved the General Plan Amendment; WHEREAS, the City Council has made the following finding: The City Council has been advised that subject to meeting City standards and requirements, the proposed General Plan amendment would substantially conform to the adopted Community Improvement Plans (CIP) for the Business and Waterfront Improvement Project and the West End Community Improvement Project and the General Plan policies incorporated by reference within the CIPs; and WHEREAS, the City Council has made the following findings relative to the General Plan Amendment: The proposed General Plan text and diagram amendments are consistent with the intent of the General Plan' which designates the project site for General Industry and Parks and Public Open Space. This designation permits a broad range of industrial and commercial uses with provisions for shoreline public access, including the type of use proposed by the project. 2. The proposed General Plan text, and diagram amendments will have no significant adverse effects on the environment, as indicated in the Mitigated Negative Declaration. The proposed General Plan text, and diagram amendments will have no significant adverse effects on the general welfare of the community because they will facilitate development of a currently underutilized site with a research and development campus. 4. The proposed General Plan text, and diagram amendments are necessary to enable the appropriate development and maintenance of property in the City because they will facilitate development of a currently underutilized site with a research and development campus.. 5. The proposed General Plan text, and diagram amendments are in the public interest. The amendments would recognize that the site is no longer designated for a port use in the regional Seaport Plan, and would allow redevelopment of the site with a more 2 appropriate use consistent with the adjacent Marina Village Business Park, and that will increase tax revenues to the City and provide substantial public amenities. 6. The text amendment to Polices 2.8b and 2.8c would allow the General Plan to conform to the Bay Conservation and Development Commission's and Metropolitan Transportation Commission's Seaport Plan by reflecting the plan's deletion of the project site as a port priority use area. 7. The General Plan Diagram amendment to realign the public open space trail to the shoreline would maintain and enhance the General Plan's objective of providing open space adjacent to the Estuary, and would allow a direct link to and continuation of the Bay Trail on the project site. THEREFORE BE IT RESOLVED that the City Council of the City of Alameda approves of General Plan Amendment, GPA -97 -01 as follows: Page 37. Encinal Terminals Area: Alameda Belt Line Railroad and Encinal Terminals depend on and are depended upon by five industries that have been in Alameda for many years and have indicated their intention to stay (Weyerhauser, Del Monte, Pennzoil, Alameda Liquid Bulk and Georgia- Pacific). To shield such sites from pressures for commercial - residential conversion, the Seaport Plan prepared by the Bay Conservation and Development Commission (BCDC) and the Metropolitan Transportation Commission (MTC) has designated Berths 1, 2, 3 and 4 of Encinal Terminals as a Port Priority Use Area. Page 39. 2.8.b Maintain existing and potential bulk cargo seaport capacity at Berths 1, 2, 3 and 4 of Encinal Terminals and Alameda Gateway consistent with the Seaport Plan prepared by the Metropolitan Transportation Commission and the Bay Conservation and Development Commission. 2.8.c Support continued operation of manufacturing and distribution industries using seaport and rail facilities. Berth 5 of Encinal Terminals is not included in this Seaport area. The General Plan Diagram shall be amended to realign to realign the Bay Trail by amendment of the Parks and Open Space designation on the General Plan Diagram from the western side of the project site to the shoreline. 3 NOTICE. No judicial proceedings subject to review pursuant to California Code of Civil Procedures Section 1085 may be prosecuted more than ninety (90) days following the date of a decision by the City Council, or any final action on any appeal, plus extensions authorized by California Code of Civil Procedure Section 1085.
