APPROVING A WAIVER OF SUBDIVISION MAP ACT REQUIREMENTS TO
SEPARATE OUT THE ATLANTIC AVENUE PUBLIC RIGHT-OF-WAY FROM
A CITY OWNED PARCEL ALONG ATLANTIC AVENUE BETWEEN WEBSTER
STREET AND CONSTITUTION WAY
WHEREAS, a parcel exists which contains a portion of the
Atlantic Street right-of-way as a consequence of the 1986 Atlantic
Street realignment; and
WHEREAS, this parcel cannot be conveyed without separating
this right-of-way from the City owned parcel; and

WHEREAS, the waiver of Subdivision Map Act requirements are

&lowed under the Subdivision Map Act provisions found in
alifornia Government Code Section 66428(b) and Section 30-78.6 of
he City of Alameda Subdivision Ordinance; and
WHEREAS, Government Code Section 66428(a) (2) allows land
onveyed'to or from a governmental agency without a Parcel Map; and
WHEREAS, the proposed site development, and sale and payment
of the land to be conveyed was subject to extensive public
hearings; and
WHEREAS, the proposed division of land complies with the
City's Ordinance as to area, improvement and design, drainage,
improved public roads, sanitary facilities, water supply,
environmental protection, and no public improvements will be
necessary or desirable as a consequence of the proposed division.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Alameda that the City Council approves the waiver of Subdivision
Map Act requirements to separate the Atlantic Avenue right-of-way
from the City owned parcel along Atlantic Avenue between Webster
Street and Constitution Way.
