CONSENTING TO AND CALLING A JOINT PUBLIC HEARING OF THE CITY
COUNCIL AND THE COMMUNITY IMPROVEMENT COMMISSION OF THE CITY
OF ALAMEDA ON THE PROPOSED COMMUNITY IMPROVEMENT PLAN FOR THE
ALAMEDA POINT IMPROVEMENT PROJECT AND CONSENTING TO A
CONCURRENT PUBLIC HEARING OF THE COMMISSION ON THE DELAY OF
APPLICATION OF CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) TO
THE PLAN ON FEBRUARY 17, 1998
WHEREAS, the Community Improvement Commission of the City of Alameda
(the "CIC"), by Resolution No. 98-72 on January 6, 1998, submitted to the
City Council of the City of Alameda (the "City Council") a proposed
Community Improvement Plan (the "Plan") for the Alameda Point Improvement
Project (the "Project"); and
WHEREAS, the City Council acknowledges receipt of the proposed Plan,
along with the Report to the City Council on the proposed Plan; and
WHEREAS, Section 33355 of the California Community Redevelopment Law
(Health and Safety Code Section 33000 et seq.) authorizes a joint public
hearing on the proposed Redevelopment Plan with the consent of the CIC
and the City Council; and
WHEREAS, pursuant to Section 33492.18 of the California Community
Redevelopment Law, the CIC also desires to hold concurrently with the
joint public hearing on the Plan, a public hearing of the CIC to consider
and act upon a determination that the need to adopt the Plan at the
soonest possible time requires the CIC to delay application of the
provisions of the California Environmental Quality Act ("CEQA") to the
proposed Plan and has requested the City Councils' consent to such
concurrent CIC public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda that:
Section 1. The City Council hereby consents to and, at the request
of the CIC, calls a joint public hearing of the CIC and the City Council
on the proposed Community Improvement Plan for the Alameda Point
Improvement Project and all documents and evidence pertaining thereto and
consents to a concurrent public hearing of the CIC on the delay in
application of CEQA to the Plan on February 17, 1998, at 7:25 p.m. in the
City Council Chambers, Alameda, 2263 Santa Clara, Alameda, California,
to consider and act upon.
Section 2. The City Clerk of the City of Alameda shall, in
cooperation with the CIC, prepare, publish, and mail such notices and
documents and do all other acts as may be necessary to carry out the
purposes of this resolution.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 6th
day of January , 1998, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr
and President Appezzato - 4:
NOES: None.
ABSENT: Councilmember Lucas - 1.
ABSTENTIONS: None.
