DENYING THE APPEAL AND UPHOLDING THE HISTORICAL ADVISORY
BOARD'S DENIAL OF THE CERTIFICATE OF APPROVAL TO DEMOLISH
AN EXISTING SINGLE-FAMILY RESIDENCE LOCATED AT 1621 ENCINAL
AVENUE
WHEREAS, an application was made by on May 5, 1997 by Pavement Engineering, Inc.
and the Church of Jesus Christ of Latter-day Saints to permit the demolition of a structure on a
site listed on the Historical Building Study List; and
WHEREAS, the application was accepted as complete on December 3, 1997; and
WHEREAS, the General Plan designation is Medium-density Residential; and
WHEREAS, the Zoning Ordinance classification is R-4, Neighborhood Residential

District; and

WHEREAS, the Historical Advisory Board held a public hearing on this application on
December 8, 1997 and has examined pertinent maps, drawings, and documents; and
WHEREAS, the Historical Advisory Board denied Certificate of Approval, CA-97-05,
based on the findings in the Historical Advisory Board Resolution HAB-97-09; and
WHEREAS, Gary Lee filed an appeal to the City Council of the Planning Board action
on December 15, 1997; and
WHEREAS, the City Council held a public hearing on this appeal on January 20, 1998
and has examined pertinent maps, drawings, and documents; and
WHEREAS, the City Council has made the following finding with respect to the
appellant's bases of appeal:
The existing structure provides valuable background support for the adjacent
residence, addressed 1617 Encinal Avenue, which represents a unique and unusual
use of architecture due to the facade constructed on the street elevation of the
structure.
2. In its present condition, the subject dwelling contains the original roof and eave
detailing and window mullions which represent the California Bungalow
architecture prominent from 1910-1925, and it part of an intact neighborhood of
Craftsman style homes which provide background support to the unique structure
at 1617 Encinal Avenue.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda
hereby upholds the action of the Historical Advisory Board and the denial of the Certificate of
Approval, CA- 97 -05, based upon the above findings.
NOTICE. This decision by the City Council regarding an appeal of call for review is final
as of the date of this Resolution unless judicial review is initiated pursuant to California Code of
Civil Procedure Section 1094.5. Any such petition for judicial review is subject to the provisions
of California Code of Civil Procedure Section 1094.6 after the date of this decision.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 20th
day of January , 1998, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr,
and President Appezzato - 4.
NOES: Councilmember Lucas - 1,
