Resolution 12954E u. 0 CITY OF ALAMEDA RESOLUTION NO. 12954 DENYING THE APPEAL AND UPHOLDING THE HISTORICAL ADVISORY BOARD'S DENIAL OF THE CERTIFICATE OF APPROVAL TO DEMOLISH A CONTRIBUTING STRUCTURE WITHIN THE NATIONAL REGISTER PARK STREET COMMERCIAL DISTRICT WHICH IS A CITY MONUMENT LOCATED AT 2411 WEBB AVENUE WHEREAS, an application was made by James Thomson for David Lau et al to request a Certificate of Approval to permit the demolition of a contributing structure within the National Register Park Street Commercial District which is a City Monument; and WHEREAS, the General Plan designation is Community Commercial; and WHEREAS, the Zoning Ordinance classification is C-2, Central Business District; and 0 WHEREAS, the Historical Advisory Board held a public hearing on December 4, 1997 to consider Certificate of Approval, CA-97-11, 4-, co) ca 1.--and upon due consideration denied the application; and WHEREAS, an appeal was made on December 18, 1997 by James Thomson to the City Council of the denial of the Certificate of Approval; and WHEREAS, the City Council held a public hearing on this appeal 1 on January 20, 1998, and has examined pertinent maps, drawings and documents; and WHEREAS, the City Council finds that there is no merit to the bases of the appeal based on Staff's response to the bases as set out in the Staff Report prepared for the January 20, 1998 City Council meeting; and WHEREAS, the City Council denies the appeal filed by James Thomson and upholds the decision of the Historical Advisory Board to deny Certificate of Approval, CA-97-11; and WHEREAS, the City Council of the City of Alameda makes the following findings: 1. The building is a contributing structure within the National Register Park Street District. It is located in an area where the historic fabric has begun to be eroded; loss of this building would cause further deterioration of the area. 2. The building has importance both in Alameda's economic and industrial history and as a example of early 20th century industrial architecture. 3. Although approximately $30,000 seismic retrofitting is required because the building is an unreinforced masonry building, and has experienced deferred maintenance, the building could be rehabilitated and is capable of earning an economic return on its value. 4. Removal of the two existing oil tanks in front of the building and any soil remediation necessary would be required if the building is rehabilitated or demolished. NOW, THEREFORE, BE IT RESOLVED that the City Council denies Certificate of Approval, CA-97-11 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 20th day of January , 1998, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas and President Appezzato - 5.
