CONFIRMING TIC COSTS OF ABATEMENT ON PROPERTY
AT 2052 SAN ANTONIO AVENUE, ALAMEDA, CALIFORNIA,
AND IMPOSING A SPECIAL ASSESSMENT ON THE
PROPERTY
The City Council of the City of Alameda finds as follows:
1. That the address of the property subject to the hereinafter described abatement
proceedings is 2052 San Antonio Avenue, County of Alameda, State of California (the "Property ").
2. That the owners of the Property at all times material herein were Hai Tao
Tang, Kitty Wan and Margaret Tong (collectively the "Owners ").
3. That the City of Alameda filed a lawsuit in Alameda Superior Court on
November 25, 1996 entitled City of Alameda v. Hai Tao Tang et al., Action No. 774407. Judgment
to abate the nuisance was granted on April 11, 1997. Said judgment authorized the City of Alameda
to abate the conditions upon the failure of the defendants to do so.
4. That the defendants failed to abate the nuisance pursuant to the judgment. On
October 14, 1997, the City entered the Property, and partially abated the conditions existing thereon 20
in order to render the Property uninhabitable. In abating those conditions, the City incurred costs of
abatement in the sum of $825.48.
5. That a statement of costs was served on the Owners pursuant to Alameda
Municipal Code subsection 13- 10.8(a)(1) on December 1, 1997. Notice of hearing to confirm the
costs of abatement was served on the Owners on January 7, 1998.
6. That pursuant to Alameda Municipal Code subsection 13 -10.8 (b)(2), the City
Council of the City of Alameda held a public hearing on January 20, 1998 to consider the
confirmation of costs of abatement and to consider all protests.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda:
1. That the costs of abatement on the property located at 2052 San Antonio
Avenue, City of Alameda, County of Alameda, State of California in the amount of $825.48 are
hereby confirmed.
2. That the City Manager, or his or her designee, shall prepare a Notice of Special
Assessment, and shall cause the same to be transmitted to the Alameda County Tax Collector, who
shall be instructed to place the Notice of Special Assessment on the assessment roll to be collected
at the same time and in the same manner as real property taxes.
3. That the City Manager, or his or her designee, shall cause a copy of the Notice
of Special Assessment to be recorded with the Alameda County Recorder in order to give notice of
the existence of the obligation to subsequent purchasers and owners.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 20th
day of January , 1998, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas
and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
