Resolution 13032CITY OF ALAMEDA RESOLUTION NO, 13032 RESCINDING RESOLUTION NO. 13025 AND CALLING A CONSOLIDATED SPECIAL MUNICIPAL ELECTION IN THE CITY OF ALAMEDA ON NOVEMBER 3, 1998 FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS THE QUESTION OF WHETHER THE 2% PORTION OF THE UTILITY USERS TAX, ADOPTED VIA ORDINANCE NO. 2691 ON MAY 2, 1995, IS TO BE CONTINUED WHEREAS, the City Council of the City of Alameda adopted Ordinance 2691 on May 2, 1995, which ordinance increased the rate at which the utility users tax is imposed from 5.5% to 7.5 %; and WHEREAS, in November 1996, the voters of the state adopted Proposition 218, which, among other things, added Article XIIIC to the California Constitution; and WHEREAS, Article XIIIC of the Constitution requires that any local general tax increased after January 1, 1995, shall continue in effect only if approved by a majority vote of the voters, voting in an election on the issue; and WHEREAS, Resolution No. 13025 was adopted by the City Council on July 21, 1998. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the following question shall be submitted to the registered voters of the City of Alameda at the Consolidated General Municipal Election to be held on November 3, 1998: Shall the existing 2% portion of the utility users tax on telephone users, electricity users, gas users, and cable television users, adopted via Ordinance No. 2691 on May 2, 1995, be continued? BE IT FURTHER RESOLVED that the City Council adopts the provisions of subdivision (a) of section 9285 of the Elections Code to permit rebuttal arguments, if arguments have been filed in favor of and against the measure which is being submitted to the voters of the City at this Consolidated General Municipal Election. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to transmit a copy of this resolution to the City Attorney, who shall prepare an impartial analysis of the ballot measure. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a certified copy of this resolution with the Alameda County Clerk of the Board of Supervisors and the County Registrar of Voters for inclusion in the November 3, 1998 Consolidated General Municipal Election ballot. BE IT FURTHER RESOLVED that Resolution No. 13025 is hereby rescinded.
