Resolution 13052CITY OF ALAMEDA RESOLUTION NO. 13052 STATING COUNCIL'S INTENTION TO SUBMIT MEASURE TO THE ELECTORS AT JUNE 8, 1999 SPECIAL ELECTION TO RAISE REVENUES TO FUND ON-GOING ARBITRATION COSTS AND RETIREE COSTS WHEREAS, the City Council has adopted Resolution No.13051 making findings; considering the Opinion and Award of Arbitrator Armon Barsamian, dated July 15, 1998 (regarding the Fire Department Employees represented by the International Association of Firefighters, Local 689); approving certain wages, benefits and employee related expenses for Fire Department employees represented by Local 689 pursuant to Charter Section 17-17; calling a special election, to be held on June 8, 1999, for consideration of a'special tax to raise revenues to pay those wages, benefits and employee related expenses for such employees over those approved by Resolution No.13051 for the years 1995-97 ("Additional Financial Burdens"); and directing staff to prepare a resolution or ordinance imposing such a special tax; and WHEREAS, certain increases in wages and benefits for Fire Department employees result in increases in retirement benefits for members of the City of Alameda "1079 Plan" (hereafter "Retiree Costs"); and WHEREAS, the Council intends to place a second measure before the voters at the June 8, 1999 election, to be effective only if the special tax to pay the Additional Financial Burdens (the first measure) is approved; and WHEREAS, the second measure would ask the voters to approve a special tax to raise revenues to fund the on-going annual cost of the wages, benefits and employee related expenses included in Arbitrator Barsamian's Award, based on the 1998 calendar year costs (the "On-Going Arbitration Costs") and the Retiree Costs so long as such costs are required to be paid; and WHEREAS, if the second measure fails and the special tax to fund the On-going Arbitration Costs and Retiree Costs is not approved, the City will continue to pay the On-Going Arbitration Costs and Retiree Costs unless such costs are reduced or eliminated through the meet and confer process; rather, approval of the second measure will enable the Council to continue to exercise its legislative discretion to determine how unrestricted revenues should be spent on an on-going basis by establishing a dedicated revenue source to pay the On-Going Arbitration Costs and the Retiree Costs; and WHEREAS, the On-Going Arbitration Costs and the Retiree Costs (both annual) are as follows: On-going Arbitration Costs $1,197,018 Retiree Costs $ 296,870 Total $1,493,888 Rounded to $1,490,000 NOW, THEREFORE, BE IT RESOLVED that no later than the 88th day before the June 8, 1999 election, the Council will adopt a resolution: (1) imposing a special tax pursuant to California Constitution Article XIIIC, section 2(d), to be used to pay the "On-Going Arbitration Costs" and "Retiree Costs" described above; and (2) increasing the City's appropriations limit pursuant to California Constitution Article XIIIB, section 4. The resolution shall be effective only if approved by two-thirds of the voters voting at the election and only if the measure to be submitted to the voters pursuant to Resolution No. 13051 is approved. The resolution shall specify that the proceeds of the tax will be placed into a special fund to be used only for the purpose of paying the "On-Going Arbitration Costs" and "Retiree Costs" described above. The resolution shall further specify the type of tax, the rate of tax, the persons subject to the tax, the duration of the tax, the manner of collection of the tax and such other matters required for the imposition and collection of the tax. The City Manager is directed to notice a public hearing for Council consideration of such resolution no later than 88 days before the June 8, 1999 election.
