Resolution 13094CITY OF ALAMEDA RESOLUTION NO. 13 0 9 4 CONFIRMING THE COSTS OF ABATEMENT ON PROPERTY AT 617 -B PACIFIC AVENUE, ALAMEDA, CALIFORNIA, AND IMPOSING A SPECIAL ASSESSMENT ON THE PROPERTY The City Council of the City of Alameda finds as follows: 1. That the address of the property subject to the hereinafter described abatement proceedings is 617 -B Pacific Avenue, County of Alameda, State of California (the "Property "). 2. That the owner of the Property at all times material herein was Clayton H. McCanliss ( the "Owner). 3. That on January 9, 1998, the Police Department of the City of Alameda responded to a complaint about the owner of the Property living in his automobile, and in the course of investigation, discovered that the residence occupied by Mr. McCanliss was uninhabitable, lacking both electricity and running water. The residence contained trash and various types of vermin. 4. That on February 11, 1998, the Owner executed.a Consent to Abate, a copy of which is attached hereto as Exhibit A, and that on April 15, 1998, owner McCanliss executed a Consent to Board and Secure, a copy of which is attached hereto as Exhibit B. 5. That during the period March 25 through March 28, 1998, a City- employed contractor entered the Property, and partially abated the conditions existing thereon in order to remove that debris which could be hazardous to the neighbors, and on April 23, 1998, entered the Property and boarded up the property. In abating those conditions, the City incurred costs of abatement in the sum of $3,380.29. 6. That a statement of costs was served on the Owner pursuant to Alameda Municipal Code subsection 13- 10.8(a)(1) on June 16, 1998, September 1, 1998, and October 1, 1998. Notice of hearing to confirm the costs of abatement was served on the Owners on February 2, 1999. 7. That pursuant to Alameda Municipal Code subsection 13 -10.8 (b)(2), the City Council of the City of Alameda held a public hearing on February 16, 1999 to consider the confirmation of costs of abatement and to consider all protests. CACODE- ENFTACIFIC\617\\CONF CST.RES 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda: 1. That the costs of abatement on the property located at 617 -B Lincoln Avenue, City of Alameda, County of Alameda, State of California in the amount of $3,380.29 are hereby confirmed. 2. That the City Manager, or his or her designee, shall prepare a Notice of Special Assessment, and shall cause the same to be transmitted to the Alameda County Tax Collector, who shall be instructed to place the Notice of Special Assessment on the assessment roll to be collected at the same time and in the same manner as real property taxes. 3. That the City Manager, or his or her designee, shall cause a copy of the Notice of Special Assessment to be recorded with the Alameda County Recorder in order to give notice of the existence of the obligation to subsequent purchasers and owners.
