Resolution 13103CITY OF ALAMEDA RESOLUTION NO. 13103 AUTHORIZING OPEN MARKET PURCHASE OF CITY -WIDE RADIO COMMUNICATIONS SYSTEM UPGRADE FROM MOTOROLA, INC. PURSUANT TO SECTION 3 -15 OF THE ALAMEDA CITY CHARTER WHEREAS, the Police Department has determined that the existing City -wide radio communications system must be upgraded in order to address various performance problems, as well as necessary digital upgrade requirements and narrow band issues; and WHEREAS, sufficient funds are available for the radio communications system upgrade from interest savings derived from the refunding of Harbor Bay Business Park Special Assessment District Bonds; and WHEREAS, based on an analysis by Telecommunications Design Services of the existing radio communications system and available options for upgrading the system, the Police Department has determined that the best available option is to contract with Alameda County to become part of their trunking system, and to purchase upgraded radio equipment from Motorola, Inc.; and WHEREAS, Section 3 -15 of the City Charter provides that the City Council, by four votes, can authorize an open market purchase if it determines that the materials or supplies can be purchased at a lower price in the open market, or that great necessity or emergency requires immediate action; and WHEREAS, the City Council has determined that all other practical alternatives were examined, and that the installation of trunk service with Alameda County and the purchase of a radio communications system upgrade from Motorola, Inc. is the best option for a radio communications system upgrade available to the City of Alameda at this time, which can be purchased at the lowest price available through an open market purchase directly from Motorola, Inc. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that pursuant to Section 3 -15 of the City Charter, and by four votes, the City Council hereby authorizes the Police Chief or his authorized representative to purchase a radio communications system upgrade from Motorola, Inc. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th day of May , 1999, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and President Appezzato - 5.
