Resolution 13140CITY OF ALAMEDA RESOLUTION NO. 13140 AUTHORIZING THE CITY MANAGER TO NEGOTIATE IN THE OPEN MARKET PURSUANT TO SECTION 3 -15 OF THE CITY CHARTER FOR CONSTRUCTION OF VETERANS' MEMORIAL BUILDING ROOF REPAIRS, NO. P.W. 08 -99 -21 WHEREAS, recent examination of the current conditions of the roof of theVeterans' Memorial Building indicates there is need for immediate repair; and WHEREAS, a major stou zi will cause considerable damage to the above areas if not repaired immediately; and WHEREAS, plans and specifications for roof repair have been prepared and approved by the Public Works Department; and WHEREAS, open market negotiation is necessary in order to be able to complete construction of the project before the rainy season, because there is not enough time to competitively bid this project and complete construction before the rainy season; and WHEREAS, in accordance with Section 3 -15 of the City Charter, the Council may, by four (4) votes, determine that the great necessity or emergency requires immediate action and thereupon proceed to acquire a contractor in the open market to make necessary repairs; and WHEREAS, allocation of $89,000 from City Building Improvements (CIP 83 -02), $68,000 from Upgrade Park Building (CIP 90 -13) and $30,000 from General Fund Reserves is required for the project. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that pursuant to Section 3 -15 of the City Charter, the City Council hereby reallocates $157,000 from City Building Improvements (CIP 83 -02) and Upgrade Park Building (CIP 90 -13) and allocate $30,000 from the General Fund Reserves and authorizes the City Manager and/or his authorized representative to negotiate and execute an open market contract for Veterans' Memorial Building Roof Repair, No. P.W. 08- 99 -21. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 7th day of September , 1999, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5.
